Actual Observation Report in a Proceeding Before the NLRC

Name of Student: CASSIUS M. GARCIA

Date/Time of Observation: February 14, 2017; 10 a.m.

Court: National Labor Relations Commission, Banawe Street, Quezon City

Case Name: Edcel Margallo Marigos v. Ventical Space Interiors Inc.

Labor Arbiter: Joanne G. Hernales-Lazo

NLRC NCR Case No. : 01-00121 17

Date of Filing: 2 February 2017

Name of the Aggrieved Party: Edcel M. Manigos

Construction Installer

Name and Address of Employer: VENTICAL SPACE INTERIORS INC.

Niog 3, Bacoor, Cavite

Nature and Subject of the Grievance: Illegal Dismissal

Disposition:
No settlement. Mediation is terminated. Set the filing of position papers on March 10, 2017.

Observations:
The courtroom was very small, much smaller and less impressive than I expected. This was
especially the case because there were no other spectators in the room.

The case I witnessed involved an illegal dismissal of a project worker who was employed by
Ventical Space Interiors Inc. as a construction installer. His work involved the installing of
ceilings.

For the past ten (10) months Edcel Manigos was continuously assigned to work in different
project sites. According to the petitioner, he was not apprised of the project that he will
undertake under a written contract. Until some time of December 2016, petitioner was told that
he could not work anymore because the respondents are not satisfied with his performance.
Hence, the petition was made.

The respondent did not attend either one of the conferences. Thus, the petitioner is ordered to
file its position paper on March 10, 2017 for decision.

The court as I have seen in act is efficient in hearing and settling labor disputes and achieving
accurate results.

In general, I believe that it was a valuable insight into the legal action of labor relations
proceeding.

Case Name: Taopo v. Adco Blue CTC

Labor Arbiter: Lilia S. Savari

NLRC NCR Case No. : 01-00102 17

Date of Filing: 24 January 2017

Name of the Aggrieved Party: Ronnel D. Taopo

Carpenter

Name and Address of Employer: ADCO BLUE CTC

Pasong Tamo, Makati City

Nature and Subject of the Grievance: Illegal Termination

Disposition:
Compromise settlement was not reached by the parties. They were ordered to file their position
papers.

Observations:
Taopo is a carpenter employed by Adco Blue CTC, a construction company. He has rendered
sporadic services for one (1) year in the said company way back January 5, 2016 until his
dismissal. Petitioner filed complaint for regularization and monetary benefits. However his
employer argued that Taopo is just a project employee to whom they hired on their Alabang and
Laguna project, also depending on the availability of projects.

Adco Blue CTC made a counter-offer of rehiring the petitioner for the Cebu project and will
increase his pay as compared to his previous project assignments.

However, Taopo decline and is willing to pursue his cause before the Labor Arbiter.
