The Complaint alleges:

In connection with the purchase of the Property, on May 27, 1997, Dwayne White,
Theresa White, Gaston Williams and Thesola Williams, as Grantor, executed and
delivered a deed of trust in favor of Mortgage Choice, Inc. (the Lender), as beneficiary,
recorded on May 29, 1997, in Book 7483, Page 617 of the Wake County Public Registry
(the First Deed of Trust) to secure the purchase price for the Property.

Plaintiff is the current holder of the obligations secured by the First Deed of Trust.

On May 3, 2005, Hope Darby Carmichael, as Commissioner for Parkway HOA, executed
and delivered a Commissioners Deed to Parkway HOA, which was recorded on May 3,
2005 in Book 11344, Page 1813 of the Wake County Public Registry (Foreclosure
Deed) pursuant to an order entered by the Clerk of Superior Court of Wake County in the
HOA Foreclosure Proceeding.

On August 10, 2005, Parkway HOA as Grantor, executed and delivered a Special Warranty
Deed to Theresa White, as Grantee, which deed was recorded on August 17, 2005 in
Book 11532, Page 125 of the Wake County Public Registry (HOA DEED).

The record owner of the Property is Theresa White.

On June 20, 2006, Dwayne White, Theresa White, Gaston Williams and Thesola
Williams, as Grantor, executed and delivered a deed of trust in favor of the Secretary of
Housing and Urban Development, as beneficiary, recorded on July 14, 2006, in Book
12060, Page 1552 of the Wake County Public Registry (the Second Deed of Trust).

ASSERTIONS

The foreclosed owners will be unjustly enriched by the value of the


purchase money provided by the Lender

Regarding the HOA DEED, the previously foreclosed owner is not a


bona fide purchaser because she had actual knowledge of the lien of the
First Deed of Trust.

The First Deed of Trust constitutes a first priority lien on the Property
pursuant to the Doctrine of Instantaneous Seisin.
