Notice of Recall Petition

We the outraged and loyal citizens of Jefferson County,

Missouri ask for the recall of Kenneth B Waller as Jefferson
County, Missouri Executive. Our intention to circulate a
petition of recall is to remove him from office for the following
reasons.

Reason 1.

His pursuit of suing the taxpayers of Jefferson County for a

raise and back pay in violation of Missouri state law and the
Charter of Jefferson County, Missouri. (Section 105.452-462
RSMo) (JCHRC 9.2). The Jefferson County Home Rule
Charter clearly states the application of proper salary
compensation for elected officials. The foregoing action is a
clear attempt of a "Cash Grab" and is a slap in the face to all
the hard-working citizens of Jefferson County, Missouri.

Reason 2

Developing law and contracting an ordinance for the

Prescription Drug Monitoring Program in violation of the
Jefferson County Home Rule Charter (3.4.2.27, 3.4.2.29).
This power resides with the people's representatives, the
County Council. On the evening of April 24, 2017, the County
Council moved, by a vote of 4-3, in opposition of the proposed
St Louis County Prescription Drug Monitoring Program
ordinance. Despite proper legislative procedure, in late May
of 2017, it is our belief the County Executive empowered the
Jefferson County Department of Health to enact an ordinance
through its own board to enroll Jefferson County into the St
Louis County Prescription Drug Monitoring Program. Thus,
we believe the County Executive is illegally passing laws on
the citizens of Jefferson County without representation.
Legislative actions can only be taken by the County Executive
in the form of a signed bill or veto.

Reason 3

Dereliction of duty and incompetence by the County Executive.

Numerous residents have been outraged at the County Executives
behavior towards citizens at County Council meetings and other public
forums. On several occasions the County Executive has threatened with
action with verbal threats. Has sent Cease and Desist orders to
Jefferson County, Missouri residents, through the County Counselor, to
eradicate responsibility from Jefferson County Departments to avoid
answering citizens requests or phone calls. Has publicly humiliated
attendees, private business owners, and Jefferson County Council
members, with malice, at County Council meetings.

Conclusion:

The County Executive has declared war on his own people. This clearly
is demonstrated with the above stated reasons and reckless abuse of
power. The Jefferson County Home Rule Charter clearly states in
Article IX Sect 9.6 states that any violation to this section requires the
County Executive to forfeit his office. We believe he has fulfilled that
requirement and more. The represented citizens of this notice will
circulate a petition for 6 months with a result to force a recall election.
If the County Executive removes himself from office before the end of 6
months, we shall cease the circulation of the petition.
