Alldeliveriesarecurbsidedelivery.
Duetothenatureofthegoods,deliveriesoutsideofmetroAtlantaarea,thecustomermustprovideassistancetounloadthe
goodsfromthedeliverytruck.
Uponreceiptthegoods;customermustperformavisualinspectionofthepackage.
x Noteanydamageonthedeliveryreceiptasprovidedthecarrierdriver.
x ReportthedamageinwritingandforwardacopyofthedeliveryreceipttoAbbyIronDoors.
Thereisa7daysperiodtoinspectthegooduponreceivingforconcealeddamage.
x Concealeddamageisdamageinsidepackagingthatisnonvisibleatthemomentofreceivingthegoods.
x Thedamagemustbereportedinwritingsupportedbyphotos.
Wecanholdfinishedgoodsfor30days;however,achargeof$40perpackagepermonthwillbeassessedafter30daysgrace
period.Forexample,asingledoorhas1package,anddoubledoorshave3packages.Pleasechecknumberofpackageswith

2.Return
Instockitem:
x Allreturnsmustbewithin15daysofreceiptofgoods.Restockingfeesequal30%ofthetotalinvoicepricelessshipping
cost.Shippingcostisnotrefundable.Thecustomerisresponsibleforallchargesrelatingtothereturn,suchasshipping
costandcrating.Thisreturnpolicyisineffectfromthemomenttheitemhasshippedoutofwarehouse.Anordercan
becancelediftheorderhasnotbeenshippedwithoutincurringanyfees.

3.Payments
Iftheitemyouarepurchasingisinstock,paymentinfullisexpectedwhentheorderisplacedunlessagreedotherwise.
Iftheitemyouarepurchasingisacustomorder,youwillbeexpectedtopay50%ofthebalancewhentheorderisplacedunless
agreedotherwise.Theremainingbalancewillbecollectedbeforewerelease/shipthegoodsorinstallthegoods(ifAbbyIron
Doorsinstalls).

4.Conditionsofrepair
AbbyIronDoors,initssolediscretion,shallbeentitledtodeterminewhethertorepairthedamageorreplacewithnewgoods.
AbbyIronDoorsshallbeentitledtoengageanysubcontractor,materialsupplieroranypersonorcompanytoassistin
completionoftheagreedjob.
IfthecustomerengagestheirowncontractortocompletetheworksonbehalfofAbbyIronDoors,thecustomermustsubmita
formalworkorderoncontractorsletterhead/workorderformwithcontractor'scontactinformationforjobapproval.AbbyIron
Doorsisnotresponsibleforthecostofthejobperformedforanonpreapprovedjob.

5.BuildingCodeandSafety
InareasotherthanMetroAtlanta,GA,thecustomerisresponsibleformakingsurethatourgoodswillmeettherequired
buildingcode.
Forbalconyandrailing,itisthecustomersresponsibilitytomakesurethatsuchproductiscorrectlyfastenedwithadequate
supporttotherequiredload.AbbyIronDoorsdoesnotdeclareanyweightbearingloadcapacitylimittoanyofourbalconyand
railingproducts.

6.Indemnity,Arbitrationclause&Governinglawclause
Eachpartyherebyindemnifiesandholdstheotherpartyharmlessfromandagainstallliability,claimsanddemandsforpersonal
injuryordamagetoproperty,andallotherdamageofeverykindandnaturewhatsoever,whicharisesoutof(orisclaimedtoarise
outof),orisconnectedinanymanner(orclaimedtobeconnected)withthisContractorperformancehereunder,whichisbased
upontheaction,failuretoactornegligentactofaparty.Suchindemnityshallincludealllegalfeesandexpensesrequiredtodefend
suchclaimandtoenforcethisprovisionoftheContract.Theforegoingdutyofindemnityshallnotbeaffectedbyinsurancecoverage
whichapartymighthaveineffect;however,suchindemnificationshallonlybetotheextentthatinsurancedoesnotcoverthesaid
claimofathirdparty.

Intheeventadisputeshallarisebetweenthepartiestothistermsandcondition,itisherebyagreedthatthedisputeshallbe
referredtotheArbitratorfromthecountywhereinAbbyIronDoorsislocatedforarbitrationinaccordancewiththeapplicable
UnitedStatesArbitrationandMediationRulesofArbitration.Thearbitrator'sdecisionshallbefinalandlegallybindingandjudgment
maybeenteredthereon.EachpartyshallberesponsibleforitsshareofthearbitrationfeesinaccordancewiththeapplicableRules
ofArbitration.Intheeventapartyfailstoproceedwitharbitration,unsuccessfullychallengesthearbitrator'saward,orfailsto
complywiththearbitrator'saward,theotherpartyisentitledtocostsofsuit,includingareasonableattorney'sfeeforhavingto
compelarbitrationordefendorenforcetheaward.THISCONTRACTCONTAINSABINDINGARBITRATIONPROVISIONWHICH
AFFECTSYOURLEGALRIGHTSANDMAYBEENFORCEDBYTHEPARTIES.

AllmattersaffectingthisAgreement,includingthevaliditythereof,aretobegovernedby,interpretedandconstruedinaccordance
withthelawsoftheStateofGeorgia,withoutgivingeffecttoanyconflictsoflawsprinciples.ThePartiesheretoherebyagreethat
theappropriateforumandvenueforanydisputesbetweenthePartiesarisingoutofthisAgreementshallbeanyfederalandstate
courtsinthestateofGeorgiaandeachofthePartiesherebysubmitstothepersonaljurisdictionofanysuchcourt.Theforegoing
shallnotlimittherightsofanyPartytoobtainexecutionofjudgmentinanyotherjurisdiction.

7.LimitedWarranty
Givenapropermaintenance,thefinishonthegoodsiswarrantedforaperiodoffive(5)yearsfromdateofdelivery.
Partsandthegoodsiswarrantedforaperiodoften(10)yearsfromdateofdelivery,excludingweatherstripping,doorsweep
anddoorthreshold. The glass on the door is warranted for one (1) year from date of delivery.
Thewarrantyshallbevoidifthegoodsweredamagedbycontractorsorwererepairwithoutproperauthorization.
Suchwarrantyshallnotbeapplicabletonormalwearandtear(suchas,butnotlimitedto,doorthreshold,doorsweep,weather
stripping),elementsofnature,naturaldisasters,strikes,actsofGod,orothereventsbeyondthecontrol.
Customerherebywaivestherighttorecoverforanyconsequentialdamagessufferedastheresultofanydefectivematerialsor
workmanship.
ALLOTHERWARRANTIES,WHETHEREXPRESSORIMPLIED,INCLUDINGBUTNOTLIMITEDTOWARRANTIESOF
MERCHANTABILITYANDFITNESSAREHEREBYEXPRESSLYEXCLUDED.THEREARENOWARRANTIESWHICHEXTENDBEYONDTHE
DESCRIPTIONONTHEFACEHEREOF.FAILUREOFCUSTOMERTOPAYAbbyIronDoorsINFULLUNDERTHISCONTRACTSHALL
VOIDTHEWARRANTYSETFORTHHEREINANDSUCHWARRANTYSHALLBEDEEMEDNULLANDVOID.
FailureofCustomertopermitsuchaccessshallbedeemedawaiverofallofCustomer'srightsundersuchwarranty.
