22 Q. And how are you employed?

23 A. I'm employed by the Mississippi Bureau of

24 Investigation.

25 Q. Were you employed in that capacity on

1 May 18th of this year?


2 A. Yes, ma'am, I was.

3 Q. And were you called into action in that

4 capacity?
5 A. Yes, ma'am. In the early morning of

6 Thursday, approximately 2:44 I received a phone call

7 from MBI Lieutenant Troy Travis. He advised me that

8 Jackson Police Department was requesting to issue an

9 Amber Alert from the Kroger located on I-55 North in

10 Jackson.

11 While en route to the Kroger, I was

12 notified that the Hinds County Sheriff's Department
ba

13 would be issuing the Amber Alert instead of Jackson

14 police.

15 Q. And did you respond to that call?

16 A. Yes, ma'am. I did. Approximately 3:30,

17 3:40 that morning, I arrived to the Kroger on I-55


ck

18 North.
Ja

19 Q. And what did you do when you arrived

20 there?

21 A. When I arrived to the Kroger, I was given

22 information in detail concerning the kidnapping of

23 one Kingston Frazier.

24 While at the Kroger, we also reviewed the

25 video from the parking lot surveillance that showed

1 the Toyota -- well, at first it showed a silver two


2 door car with what looked like damage to the rear

3 passenger's side arriving first. It's sitting in

4 the parking lot.


5 Later, around 1:13, approximately 1:13,

6 1:15, somewhere in there --

7 Q. Let me stop you, Investigator Weeks.

8 Is was that a.m. or p.m.?

9 A. A.m. I'm sorry. That would be in the

10 morning.

11 Approximately 1:12, 1:13, somewhere in

12 that time in the morning, a dark colored Toyota four
ba

13 door Camry pulled into the parking lot at Kroger as

14 well.

15 We noticed a female get out of the

16 vehicle, exit, come into the Kroger. The vehicle

17 was still -- had its lights on the entire time the


ck

18 vehicle was sitting there.

19 At that time, we noticed -- after the

20 female went into the Kroger, a few minutes later, we

21 noticed a male subject get out of the passenger's

22 side of the silver car, walk up to the Toyota Camry,

23 walk past it, turn around and walk back to the

24 silver car, open the passenger's side door, looked

25 like they got something out of it. Walked back to

1 the Toyota Camry, opened the door, looked inside


2 and/or stepped inside. It was hard to tell because

3 it was dark. Walks back around to the back of the

4 Toyota Camry and gets back in the Toyota Camry and


5 proceeds to drive off.

6 At that time, the silver car proceeded to

7 drive off also and was -- got on the frontage road,

8 and they all left.

9 Q. And did you later come to find out who was

10 in either of the vehicles that you just described?

11 A. Yes, ma'am. During the course of the

12 investigation, approximately 8 o'clock that morning,
ba

13 a.m., the Hinds County Sheriff's Department received

14 a call, a tip, that a Dwan Wakefield and a D'Allen

15 Washington was in the silver vehicle in question.

16 That tip came out because we had put that

17 vehicle out to the media as a potential of being


ck

18 involved in the kidnapping of Kingston Frazier.

19 Q. Were you further involved in investigation

20 of this matter?

21 A. Yes, ma'am, I was. At approximately

22 nine -- 9 o'clock that morning, 9:11, 9:10,

23 somewhere in there, the Madison County Sheriff's

24 Department received a 911 call in regards to a

25 Toyota Camry being left abandoned on a dead end road

1 in Gluckstadt. The car in question was that that we


2 had put out on the Amber Alert.

3 A deputy arrived at the scene shortly

4 thereafter. Did not witness anybody around the


5 vehicle at the time but did notice that a young boy

6 was laying deceased in the back passenger rear

7 floorboard of the vehicle, and that child was later

8 identified as Kingston Frazier.

9 Q. And did you respond to the scene as well?

10 A. Yes, ma'am, I did respond to the scene.

11 Q. Was the cause of his death obvious?

12 A. Yes, ma'am. The cause of what -- what
ba

13 appeared to be gunshots is the way he was killed

14 upon.

15 Q. And you have mentioned that you received

16 tips that Mr. Wakefield and Mr. Washington were in

17 the silver vehicle; was that correct?

18 A. Yes, ma'am. We had received information

19 that they were in the vehicle. And during the time

20 that we was at the scene, the Hinds County Sheriff's

21 Department also received a tip or information that a

22 Byron McBride was also with them during the course

23 of the night.

24 Q. Were these subjects apprehended?

25 A. Yes, ma'am. Later on in the afternoon,

1 after 3 o'clock that evening, Mr. Wakefield was


2 brought in first, then Mr. Washington, and then

3 later Mr. McBride.

4 Q. And with regard to Mr. Wakefield, you


5 stated he was brought in first?

6 A. Yes, ma'am. He was the -- brought into

7 the Madison County Sheriff's Department where he was

8 given -- his rights were read to him, his Miranda,

9 and he waived his right to speak to the

10 investigators.

11 Q. And did he subsequently give a statement

12 to officers?

13 A. Yes, ma'am. He gave a verbal statement to

14 the officers indicating that Washington was with him

15 and McBride were with him when they arrived to the

16 Kroger.

17 The reason they went to the Kroger was to

18 sell some weed to an individual that was supposed to

19 meet them there, and that was why they were there,

20 and that McBride got out of the vehicle and went and

21 stole the Toyota Camry.

22 Q. Did he indicate any awareness with regard

23 to Mr. McBride's stealing of the Honda Civic?

24 A. Yes, ma'am. He indicated that McBride

25 told him he was going to take the vehicle and go to

1 Holmes County.
2 So when he left -- when he left the

3 parking lot, they separated that night. And

4 Mr. Wakefield said that McBride contacted him and


5 advised him there was a child in the vehicle and

6 that he was going to off the child, was his

7 statement.

8 And McBride sent him a pin drop of where

9 he was located at in Gluckstadt and asked him to

10 come pick him up, said he ran out of gas also. And

11 Wakefield and Washington came to Gluckstadt and

12 picked him up. And that's -- when he got in the
ba

13 car, Wakefield said that McBride told him that he

14 had killed the kid.

15 Q. If you could, explain what a pin drop is.

16 A. On your cell phone, you can send a pin

17 drop of a map of where you're at to give your

18 location.
Ja

19 Q. Now, you stated that all three subjects

20 were apprehended. Who was apprehended next?

21 A. Next was Mr. Washington. He was

22 apprehended. Actually, he came in with counsel.

23 And he refused to give a statement. So...

24 Q. And so Mr. McBride was the final person

25 apprehended?

1 A. Yes, ma'am. He was brought in later on


2 that afternoon.

3 Q. And tell us about what happened with

4 Mr. McBride.
5 A. Mr. McBride's first statement was that, of

6 course, he wasn't there; he wasn't involved. And

7 then he finally turned around and said that he was

8 there, and he was with Washington and Wakefield at

9 the Kroger at the parking lot.

10 His statement was that he went up there to

11 the vehicle and came back and told them there was a
la
12 child in the vehicle, but they told him to go ahead
ba

13 and take it.

14 And then his statement was that while

15 traveling up I-55 close to the Nissan plant he

16 pulled over on the side of the interstate. He

17 advised that Wakefield and Washington pulled in

18 behind him. He got out of the car and walked back

19 to Wakefield's vehicle. Washington got out and

20 walked to the Toyota and said that that's when

21 Washington shot and killed the child. Then they got

22 back in the vehicle, and he drove it into the dead

23 end road.

24 Later in the interview he stated that

25 he -- he was the one that killed Kingston Frazier.

1 He stated that he took him down there to the road --


2 dead end road and that he was the one that killed

3 him, and he contacted Washington and Wakefield to

4 come pick him up.


5 Q. Now Mr. McBride, when he was taken into

6 custody, was he Mirandized?

7 A. Yes, ma'am. All three were Mirandized.

8 Q. So did Mr. McBride waive his rights when

9 he gave that statement?

10 A. Yes, ma'am, he did. He voluntarily gave

13 identify Byron DeLance McBride for the court?

14 A. Yes, ma'am. And that's him sitting right

15 there in the glasses in the red jumpsuit.

24 Frazier was in fact killed in Madison County,

25 Mississippi?

2 indicated that Kingston was alive when he left the

3 Kroger in Jackson and that he was killed in Madison

4 County. Both of them gave the statements that he


5 was killed in Madison County.

23 short hair.

25 do forensics, or what do you do?

2 Q. Was the Camry -- was it taken in by the

3 crime lab to be processed for purposes of forensics?

4 A. Yes, sir, it was taken in by the crime


5 lab.

6 Q. And if you -- if you -- I guess I'm

7 putting it this way. If Mr. McBride had been the

8 one -- if you follow the different stories, if

9 Mr. McBride had been the one who killed Kingston

10 Frazier, his fingerprints would be the only

11 fingerprints on the Camry of the three defendants;

16 of the three defendants, if Mr. McBride had actually

25 A. According to McBride's statement, he

4 Q. Okay. And when was it that Washington got


5 in the vehicle?

6 A. When they came up I-55 to the Nissan plant

7 sometime that night after they left Kroger.

8 Q. And the purpose for Washington getting in

9 the vehicle was to kill Kingston Frazier?

15 custody, was there any gunshot residue testing

20 A. No, sir. That's all been sent to the

21 crime lab being processed, still under

22 investigation.

23 Q. And you said at one point that the --

24 someone told you that, when the car was originally

25 taken from Kroger, that the three individuals were

1 aware that Kingston Frazier was in the car?


2 A. When the car was taken from -- they -- in

3 two different statements that were given, one said

4 that they were aware that the child was in the car;
5 the other one did not.

6 Q. And did any of the three reveal the motive

7 for taking the car?

8 A. Not that I'm aware of, no, sir.

9 Q. So there was no reference to a chop shop,

15 night other than the videotape of the Kroger parking

20 Mr. Johnson is seeking discovery, and that's not the

21 purpose of this hearing. This matter is still under

22 investigation.

25 hearing and discoverable -- some discovery that

4 A. That night there was no other video taken.

20 Kroger parking lot, did it stop the first time, or

21 did it leave the parking lot?

22 A. The first time I saw the vehicle, it

23 pulled through where the doors are, where the entry

24 is to the Kroger, went down, turned, and went into

25 the bottom area where there was no other vehicles

1 and turned facing the door that they just came by,
2 facing that way.

3 Q. And was the Toyota Camry there at that

4 time?
5 A. No, sir. Was not there.

6 Q. Did they leave prior to the Toyota Camry

7 getting there, or did they stay until the Toyota

9 A. They were there the whole time.

11 you identify how many individuals were in the Honda

3 the Kroger located on I-55 North in Jackson.

4 While en route, I was informed that it


5 would be the Hinds County Sheriff's Department

6 issuing the Amber Alert and not JPD.

7 Q. And when you arrived at the Kroger on

8 I-55, what, if anything, did you do?

9 A. When I arrived at the Kroger, I was given

10 more detailed information as far as the kidnapping

12 While I was also there, we reviewed the

13 video from the parking lot at the Kroger and was

14 determined that a silver two door car with damage to

16 kidnapping of Kingston Frazier.

18 media and to be put out to the public.

19 Q. And was information received regarding the

20 occupants of that vehicle?

4 with what looked like damage to the rear passenger's

8 pulled into the parking lot. A black female got out

9 of the vehicle, left the headlights on the vehicle

3 out to the public that that vehicle was of interest

4 in the kidnapping of Kingston Frazier.

8 that the subjects that were in it was one Dwan

4 Madison County. Appeared to be nobody around the

7 deputy there. The deputy arrived. Didn't see

8 anybody around the vehicle but did notice a black

9 male, young boy, in the back passenger's side

10 floorboard that had been -- appeared to have been

11 shot and killed. And he was later identified as

12 Kingston Frazier.

4 Mr. Dwan Wakefield. The second person was

7 waived his rights and did he give a statement?

8 A. Yes, ma'am. He came in, and he did have

7 and wanted him to come pick him up in Gluckstadt.

7 shot and killed Kingston Frazier there. And then he

2 Washington left the -- went to the Kroger in the

3 first place to sell a dime bag of weed. They left

4 there and went to a Wendy's on Northside Drive to


5 sell the dime bag of weed, and eventually they ended

6 up at the Shell station on Hanging Moss Road.

7 And while they're doing that, McBride is

8 gone. McBride is in the vehicle, the Toyota Camry,

9 that he has stolen with the child in the back seat

10 and driven up I-55. The only indication at that

11 moment, at this point in all of this investigation,

20 helped or assisted Mr. McBride in killing this

22 I don't think anybody in this courtroom

23 doubts that it is McBride that killed the child. I

24 think everybody knows that. I think all of the

25 investigators know that. I don't think you're going

2 investigation is going to show anything different

4 But the fact of the matter is the issue is


5 going to be whether or not my client encouraged

19 who doesn't pose -- whose past in no way indicates

20 that he poses a risk of flight or a risk of threat

21 to the community.

22 There is simply no -- not enough evidence

23 to convince -- we would argue, urging the court not

24 to be convinced that our client participated before

25 the fact in this killing. That's simply not what
