Foreword

This guide book has been published as reference for all importers, agents and
forwarding agents who are involved in the importation of products listed under
The Customs Ordinance (Import Prohibitions) 1998 Amendments 2003/2004.
The contents of this book have been dedicated to procedures in the importation
Building Materials Import Procedures

of construction products to Malaysia. All imported construction products to be


imported must conform to the technical specification stipulated in the respective
Malaysian Standards. The importers/agents are obliged to execute the essential
testing requirements in an effort to provide evidences on the conformity of the
imported products to the corresponding Malaysian Standards.

It is hoped that this guide book will serve as a useful reference for all
importers, agents and forwarding agents towards expediting the importation
of construction products listed under The Customs Ordinance (Import
Prohibitions).

1. INTRODUCTION

a) CIDB is a government agency entrusted with the enforcement of the Malaysian


Standard mandated on the importation of construction products that are listed under
the Customs Ordinance ( Import Prohibitions) 1998 Amendments 2003, 2004 & 2009,
through the issuance of Certification of Approval (COA).

b) Custom Ordinance ( Import Prohibitions) 1998 is a statute regulated under subsection


31(1) Customs Act 1967 (Act 235) whereby it is stipulated that the import of any one
product must comply with the Procedure of Importation of Construction Products
before its entry into Malaysia.

6 2. TERMS AND DEFINITIONS

a. Product : Finished product or semi-finished products or materials


used in construction works.

b. Certificate of Approval : A certificate issued by CIDB acknowledging that


the building product conforms to the respective MS
requirements.

c. Product Certification : A certificate issued by the CB that verifies the conformity


of the product to the respective MS. This certificate

sometimes known as certificate of conformity (COC).

d. Certification Body : A body accredited by STANDARDS MALAYSIA as


Certification Body or CB.

e. Laboratory : A test laboratory that has SAMM/ILAC or such


certification approved by CIDB within a stipulated
criterion.

f. Consignment : A batch of imported consigned construction product.

g. Consignment Test : A test on a batch of consigned imported product.

h. Full Test : A laboratory test that covers full range of testing


requirements as stipulated in the MS.

i. Critical Test : Laboratory test that is tested to the specific MS


requirements that have been stipulated by CIDB.

j. Verification : The physical inspection on the products by a CIDB


Verification Officer.

k. Desk Verifier : A CIDB officer in charge of accepting applications


for product verification by importers.

l. Verification Officer : A CIDB technical officer who undertakes product


verification.

m. Recommending Officer : A CIDB technical officer who is authorised to make


recommendations on the verification report prepared
by the Verification Officer.

n. Approving Officer : A CIDB technical officer who is authorised to approve


the application of COA.

o. Market Sampling : Collection of product/material samples from the


market or at the Customs entry point to be tested by
CB or any labs approved by CIDB.

p. Suspension : CIDB will not accept any applications from suspended


importers during the suspension period.

q. Black List : A list of importers who are not allowed to apply COA
from CIDB.
3. OBJECTIVE

To enforce the compliance of the imported construction materials / product to MS.

4. ROLES OF CIDB

a. Process the applications for verification of products from importers or their authorised
agents according to the stipulated procedure.

b. Perform product verifications at all KDRM points of entry throughout Malaysia.

c. Issuance of approvals in the form of e-permit or COA.

d. Collection of product samples for testing.

e. Perform inspection and product verifications at manufacturing plants.

f. Monitor PCs issued by CBs.

g. Carrying out market sampling of imported construction products.

h. Providing COA exemptions based on stipulated terms and conditions.

5. ROLES OF IMPORTERS

a. Submission of verification application through e-permit not less than 14 days before
the arrival of the product at port .

b. Ensure the completeness of the supporting documents.

c. Adhere strictly to all CIDB procedural requirements.

d. Proposed the date for product inspection at port.

e. Consistenly in consultation by CIDB officers on any uncertainties/curiosities on the


importation procedural requirements.

f. Uphold high level of integrity in any transactions with CIDB.

g. Submission of foreign CBs or labs particulars for CIDB verification prior to their
appointments.

h. Make proper arrangements for factory visits at the source country.

6. METHODS OF PRODUCT COMFORMITY TO MS

Generally. there are two methods to provide evidence of imported construction products
conformance to corresponding MS, i.e through Product Certification and, Consignment
Test. Both of these methods are described as below:

6.1. Product Certification (PC) Method

a) This method can further be categorised into two. In this method the importer
can appoint any Local or Foreign CB for the issuance of PC. Hence it can be
categorised as follows:

i) LOCAL Category
In this category, the PC is issued by a local CB accredited by
STANDARDS MALAYSIA or that which has been approved by
CIDB.

ii) FOREIGN Category


In this category, the PC is issued by a foreign CB at source country
which is accredited by an accreditation body in that country and must
be members of PAC IAF, MLA, APLAC, ILAC, and MRA signatories.
However, in exceptional circumstances CIDB may have a direct
arrangement with the CB as and when necessary.

b) Any surveillance audits made by the CB concerned must be submitted in a
single report to CIDB within the PC validity period.

c) Importers shall submit a complete sets of documents for the application for
verification of products.

d) PCs issued to Malaysian importers or directly to foreign manufacturers are non


transferrable without prior CIDB approval.

e) CIDB will carry out market sampling and results from product tests will be
given out to the relevant CBs.

f) Upon the issuance of PC the importer shall make arrangements for CIDB
officers to visit plant for inspection and product verification. The importer is
required to make all essential arrangements with the foreign manufacturer to
expedite the plant inspection. All travel expenses, air tickets, visa, airport tax/
passenger surcharge as well as accommodations and transportation to and
from the plant will be borne by the importer.

g) The importers adopting this method of confirmity will hold the responsibility
in assuring the confirmity of products to MS specification especially product
marking.

6.2. Laboratory Test Report

Laboratory Test Report is an alternative to importing products without PC. This


method is especially suitable for importers that are importing products on
cosignment basis for a relatively short period of time.
The Laboratory Test Report can be further categorised into four as follows:

i. Laboratory Test Report UPK1


ii. Laboratory Test Report with Double Inspection UPK2
iii. Laboratory Test Report (3 months validity period) UPK3
iv. Laboratory Test Report (Self Regulation) UPK4

a) Laboratory Test Report UPK1

There are two(2) choices for importers in this method:

i. Testing by local lab


In this case, the importer must contact any local Laboratories for sample 9
collection. The report will be valid for one (1) verification application
only.

ii. Testing by Foreign lab


The test may be conducted in a foreign laboratory at the source
country prior to import. It is very important for the importer to
submit the laboratory particulars to CIDB for verification. Then the
importer will make necessary arrangements for CIDB officers to

collect sample at the plant and send it to the appointed laboratory.

The product sample may be taken from a batch of construction products or


consignment intended for import in accordance to the following terms:
Test results are valid for a period of 6 months from date of issue
provided the importer has not yet imported the said products.

The Report is valid for one(1) application for product verification


only. However for sample collected by represenntative of the
foreign laboratory a Critical Test must be conducted on the
product.

Reports must be in the English Language and in accordance to CIDB
approved format.

b) Laboratory Test Report with Double Inspection UPK2



The sampling of products for a Full Test and Product Verification is
simultaneously made in the exporting country. The importer will be
responsible for making arrangements for CIDB to verify and collect
product samples for a full test in the exporting country. Tests shall
be conducted in any CIDB approved laboratories. The required
test report must be submitted to CIDB before the transportation of
the products to Malaysia point of entry. Upon the approval of the
conformance of the test report then the products can be transported
to the country. A second verification visit will be made by CIDB
officer at the point of entrance. A COA will be issued on the same
day provided all declarations are in order. This method can only be
applied for imports via land with fixed quantities and on the same day.
For this method the importer can used local laboratory or laboratory
at source country. For the later the importer needs to obtain prior
approval from CIDB before appointing the laboratory.
c) Laboratory Type Test Report (3 months validity period) UPK3

CIDB officers will collect product samples from the manufacturing plant for
Consignment Full Test (UPK). The test report is valid for a period of 6 months
from the date of issuance. CIDB will issue the Consignment Full Test Certificate
upon receive the application for the delivery of the first consignment. This
certificate is valid for 3 months from the date of the first COA issued.

Importers are given options of having their products tested in a local or foreign
laboratory.

Notes:
i. Importers are required to submit a full set of documents to CIDB for
10 verification purposes at the Malaysian point of entry as stipulated in the
procedure for Importation via Product Certification, Copies of Product
Certification replaced by certified true copies of Test Results. Importers
must bear all test cost.
ii. Only declared products/models that have been passed will be cleared for
import.
iii. Only cement products are subjected to a Compulsory Critical Test on every
consignment.

d) Laboratory Test Report (Self Regulation) UPK4

This method is meant for importers who engaged the services of third party
inspection body for the purposes of certifying products to MS. This IB must
be accredited by a recognised AB. Those using this method are required to
submit their IB details to CIDB for validation. They are further required to
make essential arrangements between CIDB and the related IB, prior to actual
import of the products. The importer is also required to submit a full inspection
report from the IB to CIDB for each consignment imported.

IMPORTANT NOTES :

i. In circumstances of scepticism arising over the construction product,


much after it has undergone and passed its consignment tests as well
as been awarded a PC; CIDB reserves its right to order the importer
to conduct extra tests such as a full test or critical test as deem fit
on the consignment. The importer will be required to immediately
arrange the test procedure and submit its results to CIDB.

ii. For importers or manufacturers which their lab are SAMM accredited
can conduct a full or critical test under the supervision of a CIDB
officer.

iii. The importer is prohibited from taking samples of products and send
them to a laboratory.

Notes :
CIDB is not responsible nor be held responsible for any loss/damage
on property or, any damage or injury whether directly or indirectly on
individual persons during a sampling or verification procedure by CIDB/
CB/agents or any authorised personnel to undertake the procedure with/
without CIDBs prior consent.
7. APPLICATION PROCESS

7.1 On-line Application Process

received from CIDB.
7.2 Manual Application Process
(In case of a technical disruption in e-permit system)

8. VERIFICATION PROCEDURE

The verification procedure on inspection of product is as follows:

a. The verification of product must be carried out by an appointed Verification Officer


as named in a letter of acknowledgement from CIDB.

b. The importer shall contact the named Verification Officer for a confirmation on
appointment time and place. All related expenses must be borne by the importer
except for the Verification Officers transportation and meal during domestic
verification ( within Malaysia ).

c. The verification of products can be carried out during week days or week ends.

d. The Verification Officer shall prepare a Verification Report within 24 hours after the
inspection.
e. The importer shall bear all the essential cost on the factory visit at the source country
by CIDB officer.

f. Importers shall ensure the Verification Officers safety at all times during the
verification exercise. The Verification Officer has the right to withdraw from the
procedure at any time if he feels that his safety is at stake.

g. Regardless of the manner of importation, the importer has to show that the product
being imported meets the requirements of the relevant MS. COA will only be issued
after the completion of a Verification process. Each verification process is chargeable
according to the table below. Importers who fail to arrange verification at the agreed/
fixed date, or, fail to inform CIDB a day prior to verification date will be subjected to
a second time charge and is required to make a new appointment for a verification
date. 13

9. VERIFICATION REGULATIONS

Product verification regulations that need to be complied by importers are as follows:

9.1 Verification Regulations

a) Verification for construction products in a container

i. The CIDB selected container for verification is located at suitable bay


for the purpose of inspection.

ii. Importers are required to allocate additional containers for


verification in cases where the Verification Officer finds the contents
of the initial container is doubtful.

iii. The original seal on the container shall not be removed before the
arrival of the Verification Officer.

iv. In cases where importers have to break the original seal for lab test,
the seal must be kept inside the container for inspection by the CIDB
Verification Officer.

v. The importer shall provide necessary equipment, digital camera,


forklift, manpower, machinery and other relevant appliances for the
unloading of construction product sampling from any part in the
container by the Verification Officer.
b) For verification of construction products in a warehouse, silo or other
appropriate storage premises:

i. Make sure all consignments are kept in a proper and convenient


manner for individual consignment inspection.

ii. The original seal and container number must be retained for
submission to the Verification Officer during product inspection.

c) For verification of construction product in vessel:

i. Make sure all consignments are kept in a proper and convenient


manner for individual consignment inspection.

ii. Make sure the BL contains complete information of the vessel
concerned.

iii. Ensure that all safety measures during inspection adheres to all
safety procedures.

9.2 General Regulations

a) The importer must provide transportation for the Verification Officer to and
from the Verification location, whenever the need arises. All transportation
costs must be borne by the importer.

b) The importer or its authorised agent (via an agent authorisation letter) must be
present throughout the verification process.

c) The importer must ensure physical safety measures are made for the Verification
Officer during the verification process.

9.3 Causes of Verification Failure

a) Importers fails to comply to any regulation which resulted in the inability of


the Verification Officer to conduct the verification process.
b) Non-compliance to markings as stated in the MS.
c) Inability of importer to provide containers that has been specified by CIDB.
d) Absence of importer or an authorised agent within the alloted hour for the
verification process.
e) The number on container seal does not match with the number stated in the BL
(except for seals issued by an OGA).
f) Absence of seal on the selected container.
g) Lost of seal or, broken before verification procedure.
h) Non-permanent markings.
i) Listed product not found in the packing list.
j) Brand or model is inconsistent with that stated in PC, packing list or letter from
manufacturer.

ACTIONS BY IMPORTERS UPON FAILURES

9.4 Conduct a Critical Test



a) The sealed number does not tally with that in the BL
b) Seal is broken before inspection is made by Verification Officer
c) Lost seal
d) Non-compliance on markings reruirements as stipulated in MS
9.5 Reverification Process

a) Unclear numbering on seal


b) Missing seal for product transfer to warehouse.
c) Labelling on the packaging does not match with the PC.

Notes:
Importers are required to acquire consignment verification and obtain a
COA for Malaysian products that have reached at their (export) destination
and returned to Malaysia (as import).

9.6 Postponement of Verification

a) Heavy rainfall at commencement of verification process.
b) 2 days postponement notice by importers before date of verification
procedure.
c) Occurence of natural disaster

10. DISCIPLINARY ACTION ON IMPORTERS

Importers found violating any regulations in a COA application process will be subjected
to the following disciplinary actions:

A. Reminder one and two

i. Alterations made in the supporting documents submitted to CIDB.


ii. Non-compliance to MS requirements on markings.
iii. Importation of construction products under the Customs Ordinance(Prohibitions
on Imports) which are not listed in the packinglist/invoice.
v. Failure to make available the CIDBs selected container.
vi. Absence of Importer or his authorised agent during the one hour allocated for
the verification process.
vii. The number on the seal does not match with that in the BL
ix. Lost seal or seal broken before verification.
x. Markings are non-permanent.
xi. Brand or model is inconsistent with that in the packing list or letter from
manufacturer.

B. 3 months suspension of COA application on the importer

Repititive offences as mentioned above whether in a different manner in each


case or the same being repeated in 3 occassions (para A).

C. Blacklisting of Importer

i. Falsifying COA/PC/Laboratory test report


ii. Falsifying supporting documents
iii. Perform any form of activities that deemed to taruish the image and credibility
of CIDB.

D. Any transfer of ownership without prior consent from CIDB, the new PC holder
shall not be certified by CIDB for a period of three (3) months from the date of PC
transfered if CIDB allows the transfer to be made, then the relevant CB can then
proceed with the transfer.
11. APPLICATION FOR EXEMPTION

Applications for exemption of COA can be considered based on the following criterion:

a) Directive by MITI or other authorised government agencies.

b) Imports for laboratory tests that have been approved by CIDB. A supporting letter
from CIDB must be attached to the application.

c) Samples taken by any CIDB official from a foreign manufacturing plant which are
meant for testing.

d) Maximum quantities of imported products for display or samples allowed:


16 i. Ceramic tiles = 3m 2 / design code
ii. Sanitary ware = 2 units/model
iii. Cement = not exceeding 500kg

Ceramic tiles/sanitary wares/cement model or design that has been approved


may not be re-considered in a period of (1) one year before the next sample
import.

If imports of products exceed a listed construction product quantity, the

products will be subjected to a Consignment Full Test.

e) Tiles that are not in the manufactured according to MS scope, e.g hand made tiles,
not dry pressed or extruded types, modes of manufacturing not covered by MS ISO
13006..

f) Importation of sanitary wares of the types unintended for the purposes set out in
MS 147, MS 1522 & MS 795 such as sanitary ware not made of Vitreous China.

g) Quantities of iron and steel products not exceeding 500kg.

h) CIDB assessment reveals the limited usage of the imported materials or any other
reasons that can be interpreted justifiable by CIDB.

1. All applications for exemption must be submitted by the product owner and
accompnaied by the following documents:
i. Application letter
ii. Specifications/brochure/technical report/product images
iii. Bill of Lading/Air Way Bill/Transportation Bill
iv. Invoice
vi. Packing List
vii. Other relevant documents

2. Exemption of COA approval that does not fulfill the above requirements will be
determined by the Application for COA Exemption Assessment Committee.
