SHOW CAUSE NOTICE

WHEREAS, the Ryan International School, Opp. BSF Camp, Sohna Road, Bhandsi, Distt.

Gurgaon, Haryana 122001 (School) was granted Provisional Affiliation for Secondary level

vide letter no. CBSE/AFF/530674(SL-00853-0809)/2008/133366 dated 06.06.2008 w.e.f.

01.04.2008 to 31.03.2011, was granted upgradation to Senior Secondary level w.e.f.

01.04.2010 to 31.03.2013 and was granted extension of Provisional Affiliation w.e.f.

01.04.2013 to 31.03.2018 vide letter no. CBSE/AFF/530674/EX-01753-1314/2013/548011

dated 17.04.2013 subject to the conditions that the school shall abide by the provisions of the

Affiliation/ Examinations Bye-Laws and instructions issued from time to time.

AND WHEREAS, taking cognizance of media reports, this office vide letter no.

CBSE/AFF/530674/2017/1798185 dated 09.09.2017 had sought complete report about the

death incident of Master Pradhuman Thakur, a student of class II of the school alongwith copy

of FIR filed in the case immediately through Email and registered post within 02 days.

Simultaneously, the Board constituted two-member fact-finding committee for enquiring into

the incident of death of the student in school premises vide this office letters dated 09.09.2017

and 11.09.2017.

AND WHEREAS, the Committee visited the school on 13.09.2017 and submitted its Inquiry

Report vide letter no. F.NO. 30350/2017-18/KVS(RO)Agra/Acad/729 dated 14.09.2017

received on 15.09.2017.
AND WHEREAS, the committee has found that Mast. Pradhuman Thakur was murdered in

the toilet due to several security and safety lapses in the school premises and the death

incident could have been averted, had the school authorities discharged their duties and

responsibilities with care and sincerity. The committee reported the following lacunas in the

school:-

The unfortunate death incident of Master Pradhuman Thakur could have been averted

had school authorities discharged their duty and responsibility with care and sincerity.

On the survey and interaction with the relevant staff on the day of inquiry i.e.

13.09.2017, the committee can conclude the Mast. Pradhuman Thakur was murdered

in the toilet. From the drop off point, walk of around 50 meters to take entry into the

main building. Adjacent to the main gate of the building is a toilet block after which are

the classrooms. Mast. Pradhuman Thakur was found murdered in the toilet which

indicates that he might have been pulled inside the toilet and killed there. The toilet

windows had no grills and hence people can access easily from outside.

The school management also failed to inform Police and Education Department

regarding incident of death of the child, which shows negligence on the part of school

administration. The incident of death of the student was reported to the Police

Authorities by the parent.

School has engaged around 35 buses for the transportation of students and staff. This

incident has happened due to negligence of the school authority as no provision of

toilets/washrooms for Drivers and Conductors/Cleaners who are involved in plying of

buses could be found separately in the school premises which indicate that they were

using the facilities meant for students and staff.


No attendant/Aaya was present at the toilet of the small children. Had the school

management deployed attendant/ Aaya, this mishap would have been avoided. It was

told that the cry of the child was not heard by any staff. This indicate complete

negligence of the school management towards safety and security.

Ms. Rakhi Verma, former Principal has resigned on 09.02.2017. Since then no regular

Principal has been appointed to look after the routine work of the school. Ms. Neerja

Batra was the acting Principal on the day of the incident.

The School building is having five floors; three floors are used for teaching learning

process and remaining two floors are kept idle. Students can access these unused

classrooms as these classrooms are not locked. Students can easily go to the building

terrace/roof as it remains open and no locking system found. The electricity panel room

is unlocked which is dangerous for the safety of the students.

Boundary wall was constructed from four sides of the building and in one corner the

school boundary wall is covered with barbed wire. The boundary wall does not have

enough height and no barbed wires put above the boundary walls as a result anybody

can jump and enter in the school premises which defeats safety objective.

The school could not produce safety certificates as per Rule 8.5 of Affiliation Bye Laws.

Fire Safety certificate has expired on 12.05.2017 and the school has not renewed it.

School is not providing potable drinking water to the students and the staff. No RO

(Reverse Osmosis) Plant installed in the school. Water drawn from bore well is

supplied through few small Aqua guards to students and staff.

No ramps and special toilets are available for differently abled students.
Sufficient CCTV cameras at prominent places have not been installed as per CBSE

guidelines. Most of the CCTV cameras installed in the school building are not

functioning.

AND WHEREAS, the school failed to discharge its responsibility to file the FIR and inform the

District Education Officer and the CBSE after knowing the incident. The FIR was

subsequently filed by the parent.

AND WHEREAS, the school has failed to observe the basic security measures as stipulated

by the Board, which are of preventive nature and could have avoided the unfortunate death of

the child.

AND WHEREAS, from the entire sequence of events, it appears that the school is guilty of

gross negligence and failed to ensure safety and security of the students in the school.

AND WHEREAS, there was no attendant/Aaya or staff in the sensitive morning hours at the

commencement of school when children are entering the school to ensure that no untoward

incident happens and children reach their classrooms safely.

AND WHEREAS, the School has failed to observe the conditions stipulated in circular no.

8/2017 dated 23.02.2017 regarding manpower in school bus for safety of school children

which inter-alia stipulates that there shall be a conductor, holding a valid license, deployed in

each bus, and his qualification, duties and functions should be in consonance with the

provisions in Rule 17 of Motor Vehicles Rules, 1993.


AND WHEREAS, the school failed to submit complete report in the matter as sought by the

Board vide letter dated 09.09.2017 which is in violation to Rule 13.3 of Affiliation Bye Laws.

AND WHEREAS, the school is found violating the provisions of Affiliation Bye-laws of the

Board willfully and the aforesaid omissions and commissions of the school are in violation of

Rule No. 3.3 (vii), 8.2, 8.5, 13.3 and 53(I) (1) of Affiliation Bye Laws and the serious safety

lapses which led to the unfortunate death of the student and attracts penal provisions under

Rule 17.1 and 17(2a)(xi) of Afflation Bye Laws of the Board.

NOW, THEREFORE, the Manager of the Ryan International School, Opp. BSF Camp, Sohna

Road, Bhandsi, Distt. Gurgaon, Haryana - 122001 is served with notice to show cause as

to why Provisional Affiliation for Secondary and Senior Secondary level may not be

withdrawn for willful violation of the provisions of the Affiliation Bye-laws of the Board.

His/Her reply to this notice should reach to the undersigned within 15 days from the date of

issue of this Notice failing which it will be assumed that School Authorities have nothing to

represent in the matter and ex-parte decision shall be taken as per rules of the Affiliation Bye-

laws of the Board.
