PLAINTIFFS MOTION TO REOPEN

Now Comes plaintiffs, by and through their attorneys, A. Dwight Pettit, Latoya Francis-

Williams, and the Law Office of A. Dwight Pettit, P.A., and Allan B. Rabineau, and pursuant to

Local Rule 111 states:

1. On August 14, 2017, after this Court was advised by the parties that the above

action had been settled as to all claims, issued a Settlement Order pursuant to

Local Rule 111. See Exhibit A

2. The entry of the Order was without prejudice, preserving the right of each party to

move to reopen this action if settlement is not consummated within 45 days.

3. As of today, September 18, 2017, Morgan State University Defendants have not

made payment to Plaintiffs consummating the parties settlement agreement

although requests have been made.

4. Accordingly, Plaintiffs now move to reopen this action against Defendant Morgan

State University, Defendant Morgan State University Campus Police Officer

David Lewis and Defendant Morgan State University Campus Police Chief Lance

Hatcher pursuant to Local Rule 111 and this Courts August 14, 2017 Order.

WHEREFORE, Plaintiffs request that this Honorable Court:

A. Reopen this action as to Defendants Morgan State University Police Officer David

Lewis, Morgan State University Chief Lance Hatcher and Morgan State University; and,

B. Grant such other and further relief as justice requires.

This Court has been advised by the parties that the above action has been settled,

including all counterclaims, cross-claims and third-party claims, if any. Accordingly, pursuant to

Local Rule 111 it is ORDERED that:

This action is hereby dismissed and each party is to bear its own costs unless otherwise

agreed, in which event the costs shall be adjusted between the parties in accordance with their

agreement. The entry of this Order is without prejudice to the right of a party to move for good

cause within 45 days to reopen this action if settlement is not consummated. If no party moves

to reopen, the dismissal shall be with prejudice.
