RESPONSE TO PLAINTIFFS MOTION TO COMPEL CORPORATE DISCLOSURES
OF DEFENDANTS DETROIT LAND BANK AUTHORITY AND DETROIT LAND
BANK COMMUNITY DEVELOPMENT CORPORATION PURSUANT TO F.R.C.P.
7.1(b)(1) AND E.D. Mich. LR 83.4

The Detroit Lank Bank Authority is a Michigan public body corporate organized pursuant

to the Michigan Land Bank Fast Track Act. 2003 P.A. 258, being MCL 124.751 124.774 and

a Second Amended and Restated Intergovernmental Agreement entered into between the Authority

and the City of Detroit, Michigan, effective as of December 19, 2013 [EXHIBIT 1].

Plaintiffs, in their motion, seek to compel Defendants Detroit Land Bank Authority

(DLBA) and Detroit Land Bank Community Development Corporation (DLBCDC) to file a

Statement of Disclosure of Corporate Affiliations and Financial Interest pursuant to both F.R.C.P

7.1(b)(1) and E.D. Mich. LR 83.4, both of which speak to the filing of said Statement by a

nongovernmental corporate party [Emphasis added]. The Second Amended and Restated

Intergovernmental Agreement, attached hereto as Exhibit 1, clearly establishes the DLBA as a

local governmental authority and as a public body corporate as authorized by Section 23(5) of

the Land Bank Fast Track Act, 2003 PA 258, MCL 124.773(5), to exercise within the City of

Detroit, Michigan the powers, duties, functions, and responsibilities of an authority under the Land

Bank Fast Track Act [Ex 1, 1]

F.R.C.P 7.1(b)(1) and E.D. Mich. LR 83.4 are therefore not applicable to Defendant

DLBA, and Defendant DLBA respectfully asks this Honorable Court to deny Plaintiffs Motion

with respect to DLBA.

Defendant DLBCDC has filed the appropriate Statement of Disclosure of Corporate

Affiliations and Financial Interest with this Honorable Court.
