AN ORDINANCE REGULATING THE SALE, MANUFACTURE, DISTRIBUTION AND USE OF FIRECRACKERS AND
OTHER PYROTECHNIC DEVICES WITHIN THE MUNICIPALITY OF CANAMAN, CAMARINES SUR

Be it ordained that the Sangguniang Bayan of Canaman in session assembled, that:

Section 1. Title. This ordinance shall be known as An ordinance regulating the sale, manufacture,
distribution and use of firecrackers and other pyrotechnic devices within the Municipality of Canaman,
Camarines Sur

Section 2. Legal Bases: RA 7183 and its IRR, RA 9514 and its IRR and RA 7160 and its IRR

Section 6. Firecrackers and Pyrotechnic Devices that are prohibited for sale, distribution and use.

a. Atomic Big;
b. Super Lolo;
c. Giant Whistle Bomb;
d. Other types equivalent to the foregoing in explosive content as mentioned in a, b, and c;
e. Firecrackers which are overweight or more than 0.2 grams or more than 1/3 teaspoon in explosive
content;
f. Firecrackers which are oversized;
g. Firecrackers which fuse burns in less than 3 seconds or more than 6 seconds;
h. Imported finished product;
i. Firecrackers with mixture of phosphorous or sulfur with that of chlorate;
j. Polyvinyl pipe boga

Section 7. Mandatory and Rigid Inspection of the Joint Task Force of the Municipal Health Office, PNP
Canaman and BFP Canaman.

There shall be a joint task force to be created by the Local Chief Executive representing the Offices of
Health, PNP and BFP Canaman that will primarily inspect all business establishments who are known to
engage in the sale, manufacture, distribution and use of firecrackers and other pyrotechnic devices within
the Municipality of Canaman in order to ensure that these establishments are compliant with this
ordinance and existing national laws relative to the regulation of firecrackers and other pyrotechnic
devices that will particularly operate.

Section 7.1 The joint task force shall operate rigidly and mandatorily starting on December 16 up to
December 22 of the existing calendar year in the inspection that will be aimed towards the prevention of
casualties due to the sale, manufacture, distribution and use of prohibited firecrackers and other
pyrotechnic devices over business establishments engaged in the same in preparation to the celebrations,
customs, and traditions being held on December 25 and January 1 of every calendar year.

Section 7.2. The PNP Canaman is authorized to confiscate prohibited types of firecrackers and pyrotechnic
devices as found in the conduct of the Joint Task Force created as provided under Section 7 of this
ordinance.

Section 7.3. The BFP Canaman is further authorized to dispose the seized prohibited articles in accordance
with existing rules and regulations as provided under the Fire Code of the Philippines and other existing
laws.

Section 8. Issuance of Mayors Permit.

No dealer and retailer of firecrackers and pyrotechnic devices shall be issued a mayors permit unless a
PNP Clearance and a BFP certification is obtained which shows assessment and evaluation over the same.
It has to be attached in the business application of said dealer and retailer together with the other
requirements necessary for the operation of business and licensing and payment of the fees included
therein.

Section 9. Mandatory information drive during the conduct of annual barangay assemblies.

The Local Chief Executive shall issue an executive order to the PNP and BFP Officials and their authorized
personnel to have representation during the conduct of barangay assemblies within the 24 barangays of
the municipality in order to intensify the campaign against the use of prohibited firecrackers and
pyrotechnic devices as provided under Section 6 of this ordinance and for other material public safety
concerns and reminders of the PNP and BFP.

Section 10. Total Ban on the Manufacturing of firecrackers and other pyrotechnic devices.
This ordinance explicitly prohibits all forms of manufacturing of any kind or type of firecrackers and
pyrotechnic devices within the territorial jurisdiction of the Municipality of Canaman.

Section 10. Display Center or Firecracker and Pyrotechnic Zone.

Every business establishment engaged in the sale, retail and distribution of Firecracker and Pyrotechnics
are to be considered, by virtue of this ordinance, as Firecracker and Pyrotechnic Zone. The display centers
shall be regulated as provided hereunder:

Section 10. 1. Each display center shall be secured by a firewall with a fire resistance rating of not less than
two (2) hours as determined by the BFP;

Section 10.2. If the display center is engaged in the sale, retail and distribution of both firecrackers and
pyrotechnic devices, it shall be separated from each other with a firewall with the same fire resistance as
mentioned under Section 10.1;

Section 10.3. Each display center shall provide, in its own, fire extinguishers in accordance with the
standards set forth by the Fire Code of the Philippines;

Section 10.4 It is absolutely prohibited for any person to smoke within the radius of 15 (fifteen) meters
from the said display center;

Section 10.5 The same absolute prohibition is provided for the testing of firecrackers and pyrotechnic
devices in any display center;

Section 10.5 Stoves, exposed flames, and portable electric heaters shall be prohibited within the display
center.

Section 11. Fireworks and Pyrotechnics Exhibition Zones.

For the benefit of this ordinance, fireworks and pyrotechnics exhibition zones are to be construed as those
places where the people conduct their foundation anniversary celebrations such as but not limited to the
barangay multipurpose pavements and other related government centers or within the respective
individual residences of persons who celebrate a occasions or events with the use of allowed fireworks
and pyrotechnic devices under Section 5 of this ordinance provided that the regulations hereunder
stipulated are strictly complied:

Section 11.1. A clearance to conduct fireworks and pyrotechnic devices exhibition from the Municipal Fire
Marshall must be obtained;

Section 11.2. A permit to possess and display fireworks pyrotechnic devices must also be secured from
the Canaman PNP;

Section 11.3. Fireworks and pyrotechnic devices shall be fired at a distance of one hundred feet (100 ft.)
away from people;

Section 11.4. All fireworks and pyrotechnic devices must be projected upwards;
Section 11.5. A responsible person of at least (21) twenty-one years old with adequate knowledge of
handling fireworks and pyrotechnic devices shall be assigned to supervise the fireworks and pyrotechnic
exhibition;

Section 11.6. Standard first aid fire protection equipment shall be on hand at the site during the fireworks
and pyrotechnic exhibition.

Section 12. Separability Clause. If any part or provision of this ordinance is held invalid or
unconstitutional by the court of competent jurisdiction, the other provisions not affected thereby shall
remain in force and effect.

Section 13. Penalty Clause. Any natural person(s) or juridical entity (ies) found to be violating any section
of this ordinance shall be fined with an amount not exceeding (Php 2,500.00) two thousand five hundred
pesos or be imprisoned in a period not exceeding (6) six months or both depending upon the discretion
of the Court.

Section 14. Repealing Clause. All ordinances which are found to be inconsistent with this ordinance are
hereby revoked, amended, and/or modified accordingly.

Section 15. Effectivity Clause. This ordinance shall take effect this ___ day of June 2017 with the
mandatory compliance of publication in newspaper of local circulation.
