SPECIAL POWER OF ATTORNEY

Know all men by these presents:

This Special Power of Attorney is being executed by:

1. Fabian Tapayan, of legal age, Filipino and resident of Paglaum II, Tuburan District,
Pagadian City, herein after referred to as PRINCIPAL;

Whereas, PRINCIPAL caused the institution of an ejectment suit for unlawful

detainer against BABE REVELO BERNANTE(Baby Bernante-Lauria) which is presently
pending before the Municipal Trial Courts in Cities, Branch 1, Pagadian City docketed as
Civil Case No. 2599;

Whereas, the PRINCIPALs health is diminishing due to his age. By reason thereof,
Principal can no longer personally prosecute his cause in the above-mentioned ejectment
case;

Whereas, the Principal intends to appoint, name, and constitute his son, FABIAN
B. TAPAYAN JR. as his attorney-in-fact and to represent the former in prosecuting the
above-mentioned ejectment case in all the stages of the case;

Now therefore, the Principal, FABIAN TAPAYAN do hereby appoint, name and
constitute FABIAN B. TAPAYAN JR. to be his true and lawful Attorney-in-Fact, and for
that purpose, in my name and in my behalf, to do and perform all or any of the following
acts, deeds, and things, to wit:

1. To enter into compromise agreement and/or amicable settlement in Principals

name and stead, attend pre-trial conference and perform all the provisions
mandated under Rule 18 of 1997 Rules of Civil Procedure, in connection with
and related to the aforementioned ejectment suit with full authority to delegate
this power to another person or attorney who will attend to the case;

2. To appear in Principals behalf whenever his appearance be required by the

Honorable Court;

3. To represent the Principal in all the stages of the proceedings of said ejectment
suit against BABE REVELO BERNANTE;

HEREBY GIVING AND GRANTING unto said Attorney-in-Fact full power and
authority to do and perform all and every act requisite or necessary to carry into effect the
foregoing authority as fully to all intents and purposes as the Principal might or could lawfully do
if personally present, with full power of substitution and revocation, and hereby ratifying and
confirming all that any of the said attorney-in-fact or his substitutes shall lawfully do or cause to
be done by virtue hereof.
