MEMORANDUM OF AGREEMENT FOR WORK IMMERSION PARTNERSHIP

This Memorandum of Agreement is entered into this 31st of August , 2017 in Tuao
Vocational and Technical School, Naruangan Tuao Cagayan, by and between:

The TUAO VOCATIONAL AND TECHNICAL SCHOOL , with School Identification Number 300492
a public high school, with principal address at Naruangan Tuao Cagayan ,
represented in this Agreement by its Principal, MARIBEL S. ARELLANO , Filipino, of
legal age, and hereinafter referred to as the SCHOOL;

-and-

The Barangay of Council of Naruangan of the Republic of the Philippines, with


principal address at Naruangan, Tuao Cagayan , and represented in
this Agreement by its BARANGAY CHAIRMAN, GODOFREDO CORSINO, of legal age,
hereinafter referred to as the BARANGAY.

WITNESSETH:

WHEREAS, the School has entered into Work Immersion Partnerships with the LGU and
private establishments at Tuao West Cagayan with the major objective of ensuring
that graduates of basic education are ready for employment, entrepreneurship and
higher learning;

WHEREAS, the School will start its Work Immersion on October 02- October 27, 2017
for the first batch (16 students) of the TVL track, Cookery, Bread and Pastry
Production and Food and Beverage Services strands at Greenside Snacks and Resto Bar
located at Centro 01, Tuao West Cagayan;

WHEREAS, these 16 students reside in Barangays Naruangan and Angang;

WHEREAS, the General Academic Strand students will have their Work Immersion at the
Local Government Unit of Tuao, Tuao West Cagayan on November 13, 2017- December 08,
2017.

WHEREAS, some of the SMAW strand students will have their Work Immersion in the
different welding shops in Tuao West Cagayan on the same dates;

WHEREAS, some of these students are residents of Naruangan, Tuao Cagayan

WHEREAS, Naruangan is located in Tuao East Cagayan which is 30 minutes away from
Tuao West;
WHEREAS, the students will find difficulty to commute in a public transport given
the number of commuters going to the West;

WHEREAS, the students need a shuttle bus to transport them from school at 7:00 am
to the workplace and from the workplace at 5:00 pm back to the school.

WHEREAS, the school does not have any vehicle to ferry the students from the school
to the workplace;

WHEREAS, the Barangay has a shuttle to be utilized for transport purposes;

WHEREAS, the Barangay is encouraged to fully support the successful implementation


of the K to 12 Program of the Department of Education as stated in Paragraph 4,
Section 2 of the Republic Act 9155 or Governance of Basic Education Act of 2001;

NOW, THEREFORE, for and in consideration of the foregoing premises, the PARTIES
hereby agree as follows:

A. Responsibilities of the School:

1. The school orients the students on punctuality to avoid delay;


2. The school provides a routing information for the driver;
3. The school informs the driver of suspension of classes;

B. Responsibilities of the Barangay:


The barangay represents and warrants the following:

1. That the bus I well maintained, in good working order and clean;
2. That the driver is duly certified and licensed under all applicable laws and
rules.
3. That the driver has been drug testes under all applicable lawas and rules;
4. That the driver will refrain from the use of tobacco products during routes or
in view of students;
5. That the Barangay through its driver inform the school of any delays as soon as
possible.
6. The barangay agrees to provide transportation for students of Naruangan for free
from school to their workplace and vice versa.

C. Compliance with Law


The Barangay warrants that all laws, rules and regulations of duly constituted
authorities having jurisdiction over its activities shall be complied by the
Barangay and its driver.
D. TERMINATION
The Parties have the right to terminate this agreement upon written notice to the
other for any reason upon thirty (30) days notice.

E. LIMITATION OF LIABILITIES
Except for the obligation of the school stated in this contract, the school shall
have no liability to the barangay or to anyone claiming through or under this
contract by reason of the execution and performance of this contract.

F. ENTIRE AGREEMENT; MODIFICATIONS


This contract supersedes all prior agreements, written or oral between the barangay
and the school and shall constitute the entire agreement between the parties with
respect to the subject matter hereof. This contract and each of its provisions
shall be binding upon the parties and may not be waived, modified, amended or
altered except by a writing signed by the school and the barangay.
G. FORCE MAJEURE
Neither party shall be liable or responsible to the other for any loss or damages
or for any delays or failure to perform due to causes beyond its reasonable control
including, but not limited to, acts of God, strikes, epidemics, or any
circumstances of like character.
H. EFFECTIVITY
This contract shall commence immediately upon both parties have affixed their
signatures;
