Purpose

TheShawneeMissionSchoolDistrictprovidescomputernetworkandInternetaccessforitsstudentsandemployees.This
serviceallowsemployeesandstudentstoshareinformation,learnnewconcepts,researchdiversesubjects,andcreate
andmaintainschoolbasedwebsites.TheschooldistricthasadoptedtheAcceptableUseGuidelinestogoverntheconduct
ofthosewhoelecttoaccessthecomputerNetworkorInternet.

StudentUsers

Allstudentusersandtheirparents/guardiansmustsignorelectronicallyconsenttothedistrict'sUserAgreementpriorto
accessingorusingdistricttechnologyresources,unlessotherwiseexcusedbythispolicyorthesuperintendentor
designee.Studentswhoare18orwhoareotherwiseabletoenterintoanenforceablecontractmaysignorconsentto
theUserAgreementwithoutadditionalsignatures.StudentswhodonothaveaUserAgreementonfilewiththedistrict
maybegrantedpermissiontousethedistrict'stechnologyresourcesbythesuperintendentordesignee.

EmployeeUsers

Noemployeewillbegivenaccesstothedistrictstechnologyresourcesunlesstheemployeeagreestofollowthedistrict's
UserAgreementpriortoaccessingorusingthedistrict'stechnologyresources.Authorizedemployeesmayusethe
districtstechnologyresourcesforreasonable,incidentalpersonalpurposesaslongastheusedoesnotviolateany
provisionofdistrictpoliciesorprocedures,hindertheuseofthedistrictstechnologyresourcesforthebenefitofits
studentsorwastedistrictresources.Anyusethatjeopardizesthesafety,securityorusefulnessofthedistricts
technologyresourcesorinterfereswiththeeffectiveandprofessionalperformanceoftheemployeesjobisconsidered
unreasonable.Unlessauthorizedbytheemployee'ssupervisorinadvance,employeesmaynotaccess,view,display,
store,printordisseminateinformationusingdistricttechnologyresourcesthatstudentsorotheruserscouldnotaccess,
view,display,store,printordisseminate.

ExternalUsers

Consultants,legalcounsel,independentcontractorsandotherpersonshavingbusinesswiththedistrictmaybegranted
userprivilegesatthediscretionofthesuperintendentordesigneeafterconsentingtothedistrict'sUserAgreementand
forthesole,limitedpurposeofconductingbusinesswiththeschool.Externalusersmustabidebyalllaws,district
policiesandprocedures.

GeneralRulesandResponsibilities

Thefollowingrulesandresponsibilitieswillapplytoallusersofthedistrict'stechnologyresources:

1.ApplyingforauserIDunderfalsepretensesorusinganotherperson'sIDorpasswordisprohibited.

2.SharinguserIDsorpasswordswithothersisprohibited,anduserswillberesponsibleforanyactionstakenbythose
usingtheIDorpassword.AuserwillnotberesponsiblefortheftofpasswordsandIDs,butmayberesponsibleifthe
theftwastheresultofusernegligence.

3.Deleting,examining,copyingormodifyingfilesordatabelongingtootheruserswithouttheirpriorconsentis
prohibited.

4.Massconsumptionoftechnologyresourcesthatinhibitsusebyothersisprohibited.

5.Useofdistricttechnologyforsoliciting,advertising,fundraising,commercialpurposesorfinancialgainisprohibited,
unlessauthorizedbythedistrict.Useofdistricttechnologyresourcestoadvocate,supportoropposeanyballotmeasure
orcandidateforpublicofficeisprohibited.

6.Accessingfeeserviceswithoutpermissionfromanadministratorisprohibited.Auserwhoaccessessuchservices
withoutpermissionissolelyresponsibleforallchargesincurred.

7.Usersarerequiredtoobeyalllaws,includingcriminal,copyright,privacy,defamationandobscenitylaws.The
districtwillrenderallreasonableassistancetolocal,stateorfederalofficialsfortheinvestigationandprosecutionof
personsusingdistricttechnologyinviolationofanylaw.

8.Thedistrictprohibitstheuseofdistricttechnologyresourcestoaccess,viewordisseminateinformationthatis
pornographic,obscene,childpornography,harmfultominors,obscenetominors,libelous,orpervasivelyindecentor
vulgar.

9.Accessing,viewingordisseminatinginformationonanyproductorservicenotpermittedtominorsisprohibited
unlessunderthedirectionandsupervisionofdistrictstaffforcurriculumrelatedpurposes.

10.Thedistrictprohibitstheuseofdistricttechnologyresourcestoaccess,viewordisseminateinformationthat
constitutesinsultingorfightingwords,theveryexpressionofwhichinjuresorharassesotherpeople(e.g.,threatsof
violence,defamationofcharacterorofapersonsrace,religionorethnicorigin)presentsaclearandpresentlikelihood
that,becauseoftheircontentortheirmannerofdistribution,theywillcauseamaterialandsubstantialdisruptionofthe
properandorderlyoperationanddisciplineoftheschoolorschoolactivitiesorwillcausethecommissionofunlawfulacts
ortheviolationoflawfuldistrictpoliciesandprocedures.

11.Thedistrictprohibitsanyusethatviolatesanyperson'srightsunderapplicablelaws,andspecificallyprohibitsany
usethathasthepurposeoreffectofdiscriminatingagainstorharassinganypersononthebasisofrace,color,religion,
sex,nationalorigin,ancestry,disability,age,geneticinformation,pregnancyoruseofleaveprotectedbytheFamilyand
MedicalLeaveAct(FMLA).

12.Thedistrictprohibitsanyunauthorizedintentionalornegligentactionthatdamagesordisruptstechnology,alters
itsnormalperformanceorcausesittomalfunction.Thedistrictwillholdusersresponsibleforsuchdamageandwillseek
bothcriminalandcivilremedies,asnecessary.

13.Usersmayonlyinstallanduseproperlylicensedsoftwareandaudioorvideomediapurchasedbythedistrictor
approvedforusebythedistrict.Alluserswilladheretothelimitationsofthedistrictstechnologylicenses.Copyingfor
homeuseisprohibitedunlesspermittedbythedistrictslicenseandapprovedbythedistrict.

14.Alluserswillusethedistrictspropertyasitwasintended.Technologyresourceswillnotbemovedorrelocated
withoutpermissionfromabuildingadministrator.Alluserswillbeheldaccountableforanyintentionalornegligent
actionstheycausethatcreatedamagetodistricttechnologyresources.

15.AllusersshallabidebyandagreenottoviolateKansasCriminalStatute213755prohibitingcrimesagainst
computers,computerpassworddisclosure,andcomputertrespass.

TechnologySecurityandUnauthorizedAccess

1.Allusersshallimmediatelyreportanysecurityproblemsormisuseofthedistrictstechnologyresourcestoateacher
oradministrator.

2.Useofdistricttechnologyresourcesinattemptingtogainorgainingunauthorizedaccesstoanytechnologysystem
orthefilesofanotherisprohibited.

3.Useofdistricttechnologytoconnecttoothersystems,inevasionofthephysicallimitationsoftheremotesystem,is
prohibited.

4.Theunauthorizedcopyingofsystemfilesisprohibited.

5.Intentionalornegligentattempts,whethersuccessfulorunsuccessful,tointerferewiththeabilityofotherstoutilize
anydistricttechnologyareprohibited.

6.Userswillbegrantedaccessprivilegestodistricttechnologyresourcesasdeterminedappropriatebythe
superintendentordesignee.Anyattempttosecureahigherlevelofprivilegewithoutauthorizationisprohibited.

7.Theintroductionofcomputerviruses,hackingtoolsorotherdisruptiveordestructiveprogramsintoadistrict
computer,networkoranyexternalnetworksisprohibited.

OnlineSafetyandConfidentiality

CurricularornoncurricularpublicationsdistributedusingdistricttechnologywillcomplywiththelawandBoardpolicieson
confidentiality.

Alldistrictemployeeswillabidebystateandfederallaw,Boardpoliciesanddistrictruleswhenusingdistricttechnology
resourcestocommunicateinformationaboutpersonallyidentifiablestudents.Employeeswilltakeprecautionstoprevent
negligentdisclosureofstudentinformationorstudentrecords.

Allstudentswillbeinstructedonthedangersofsharingpersonalinformationaboutthemselvesorothersoverthe
Internetandareprohibitedfromsharingsuchinformationunlessauthorizedbythedistrict.Studentusersshallnotagree
tomeetwithsomeonetheyhavemetonlinewithoutparentalapprovalandmustpromptlydisclosetoateacheror
anotherdistrictemployeeanymessagetheuserreceivesthatisinappropriateormakestheuserfeeluncomfortable.

ElectronicMailandMessaging

Auserisresponsibleforallemailandotherelectronicmessagesoriginatingfromtheusersemailorotherelectronic
messagingaccounts.

1.Forgeryorattemptedforgeryofelectronicmessagesisillegalandprohibited.

2.Unauthorizedattemptstoread,delete,copyormodifyelectronicmessagesofotherusersareprohibited.

3.Usersareprohibitedfromsendingunsolicitedmassemailorotherelectronicmessages.Thedistrictconsidersmore
thantenaddressespermessage,perdayaviolation,unlessthecommunicationisanecessary,employmentrelated
functionoranauthorizedpublication.

4.Whencommunicatingelectronically,allusersmustcomplywithdistrictpolicies,regulationsandproceduresand
adheretothesamestandardsexpectedintheclassroom.

5.Usersmustobtainpermissionfromthesuperintendentordesigneebeforesendinganydistrictwideelectronic
messages.

CommunicationDevices

Employeesandotherstowhomthedistrictprovidesmobilephonesorotherelectroniccommunicationdevicesmustuse
themprofessionallyandinaccordancewithdistrictpolicies,regulationsandprocedures.Thesedevicesshallnotbeused
inamannerthatwoulddistracttheemployeeorotheruserfromadequatesupervisionofstudentsorotherjobduties.

Exceptions

Exceptionstodistrictruleswillbemadefordistrictemployeesoragentsconductinganinvestigationofausethat
potentiallyviolatesthelaw,districtpoliciesorprocedures.Exceptionswillalsobemadefortechnologyadministrators
whoneedaccesstodistricttechnologyresourcestomaintainthedistrictsresourcesorexamineanddeletedatastoredon
districtcomputersasallowedbythedistrictsretentionpolicy.

Waiver

Anyuserwhobelievesheorshehasalegitimateeducationalpurposeforusingthedistrictstechnologyinamannerthat
mayviolateanyofthedistrictspolicies,regulationsorproceduresmayrequestawaiverfromthebuildingprincipal,
superintendentortheirdesignees.Inmakingthedecisiontograntawaivertoastudent,theadministratorshallconsider
thepurpose,age,maturityandlevelofsupervisioninvolved.

Thedistrictshallimplementandenforceaninternetsafetyplanmeetingtherequirementsofboththefederaland
theKansasChildrensInternetProtectionActs(CIPA).Thesuperintendentshalldevelopaplantoimplementthe
ChildrensInternetProtectionActs.

Suchplanshallincludetechnologyprotectionmeasuresandsuchothermeasuresasdeemedappropriatetoaddress
thefollowingissues:
(1)AccessbyminorstoinappropriatematterontheInternetandWorldWideWeb,
(2)Thesafetyandsecurityofminorswhenusingelectronicmail,chatrooms,andotherformsofdirectelectronic
communications,
(3)Unauthorizedaccess,includingsocalledhacking,andotherunlawfulactivitiesbyminorsonline
(4)Unauthorizeddisclosure,use,anddisseminationofpersonalinformationregardingminorsand
(5)Measuresdesignedtorestrictminors'accesstomaterialsthatmaybeharmfultothem.
Forthepurposesofthispolicy,"minor"shallbedefinedtomeananystudentwhoisunder18yearsofage.The
boardchargesthesuperintendenttodeveloptheCIPAimplementingplansothatalloftheprotectionsprovidedbythis
policyandthecorrespondingplanmaybeaffordedtoalldistrictstudents,regardlessoftheirage.

Ifthedistrictisprovidingpublicaccesstoanycomputer,theCIPAplanshallalsoimplementandenforcetechnology
protectionmeasurestoensurenominorhasaccesstovisualdepictionsthatarechildpornography,harmfultominors,or
obscene.ThisplanshallbeonfilewiththeboardclerkandineachschoolofficewithInternetaccess,andcopiesshallbe
madeavailableuponrequest.ThesuperintendentshallensurecompliancewithCIPAbycompletingFederal
CommunicationCommissionformsasrequired.
