comprehensive Legislation embodying the same principles, if enacted on an All India

Communities will be harmful and will encourage fissiparous and separatist tendencies."
The above feelings were one of the main Recommendations of the Commission
( Rai Trimbak Lal was the Director of Endowments. His statement has been

We at VAK are blessed to bring out the second volume in the series
of books on Anecdotes on Vishnu Sahasranama authored by Sri V
S Karunakaran Swamy.
Sri V S Karunakaran Swamy started this mammoth never before project
of explaining the significance of the 1000 names. Since the English
meaning of this hymn is given in this work, many in this country and
those living abroad, will welcome it. Every name is a mantra by itself,
some with two and some ranging up to eight words. The hymn is an
antidote for all ills.
As the author mentioned the benefits which will accrue by reciting
the various name of Vishnu, it has been practically experienced by
Devotees at Chilkur Balaji temple who are the regular readers of VAK
in which these Anecdotes have been serialised. There is immortal
ecstasy that can be experienced by chanting these names individually.
The second Volume has been released on 6th September 2017, as a part of the Saptatipoorthi
celebrations of the Author Sri V S Karunakaran. You can find the devotees chanting these
names endlessly at the Balaji Temple Chilkur. The benefit of chanting individual names for
particular needs to be granted by Almighty is being practiced and is yielding expected results.

EDITORIAL...
CAN GOVERNMENT TAX TEMPLES?
Hundi money of thousands of temples are collected as Tax by the State Governments and this is an
Unconstitutional activity. The Supreme Court has been approached to protect the Temples from Politicisation
and Governmental control.
The Union Government is, constitutionally duty-bound to provide a remedy for the widespread mischief
as many State Governments are unconstitutionally in-control of temple administration and are illegally collecting
tax in the name of fee from devotees to fund the salaries of officials to perpetuate the illegal control.
Since the administration of Hindu religious institutions is on the Concurrent List and only the Union
Government is entitled to make laws related to such new taxes under Article 248, it has to take necessary
action to provide a remedy and prevent unconstitutional administration of temples by State governments.
The Union Government argued in the Supreme Court that the levy on Hindu religious institutions is only
a fee, in the Shirur Mutt case in the 1950s. It has failed in its constitutional duty for several decades to monitor
how the State Governments are enforcing the provisions of the Act causing irreparable damage to these
institutions.
The SC in the Shirur Mutt Judgement makes the following observation:
"....So far as the first ground is concerned, it is not disputed that the legislation in the present case is
covered by entries 10 and 28 of List III in Schedule VII of the Constitution. If the contribution payable under
section 76 of the Act is a fee, it may come under entry 47 of the Concurrent List, which deals with fees in
respect of any of the matters included in that list. On the other hand, if it is a tax, as this particular tax has not
been provided for in any specific entry in any of the three lists, it could come only under entry 97 of List I or
article 248(1) of the Constitution and in either view the Union Legislature alone would be competent to legislate
upon it. On behalf of the appellant, the contention raised is that the contribution levied is a fee and not a tax
and the learned Attorney General, who appeared for the Union of India as intervener in this as well as in the
other connected appeals made a strenuous attempt to support this, position. The point is certainly not free
from doubt and requires careful consideration. Clearly, if the fee takes the colour of tax then it is beyond the
competence of the State legislature to levy it...."
It is also important to highlight the Supreme Courts recent Chidambaram Judgement, which said:
"...Even if the management of a temple is taken over to remedy the evil, the management must be handed
over to the person concerned immediately after the evil stands remedied. Continuation thereafter would
tantamount to usurpation of their proprietary rights or violation of the fundamental rights guaranteed by the
Constitution in favour of the persons deprived. Therefore, taking over of the management in such circumstances
must be for a limited period. Thus, such expropriatory order requires to be considered strictly as it infringes
upon fundamental rights of the citizens and would amount to divesting them of their legitimate rights to manage
and administer the temple for an indefinite period. We are of the view that the impugned order is liable to be set
aside for failure to prescribe the duration for which it will be in force.
Super-session of rights of administration cannot be of a permanent enduring nature. Its life has to be
reasonably fixed so as to be co-terminus with the removal of the consequences of maladministration. The
reason is that the objective to take over the management and administration is not the removal and replacement
of the existing administration but to rectify and stump out the consequences of maladministration. Power to
regulate does not mean power to supersede the administration for indefinite period...."
In view of the above SC ruling, if any temple is taken over and administered by the State Governments,
that statutory regulation should not exceed the limits of a reasonable restriction on the fundamental rights
guaranteed by the Constitution.
Importantly, the contribution from such temple to the Endowments Administration Fund takes the
colour of tax that State Governments do not have the power to levy on devotees.
So, it is important that the Central Government should correct this mistake. It can do so by intervening
in the writ petition filed by Swami Dayananda Saraswati (WP 476 of 2012) and correctly guiding the SC. !
We are repeating this October '17 Editorial expecting the Apex Court to do Justice to Temples.....

NEWS Are Sabarimala Temple Practices discriminatory?! Really?!
One of the primary objective of Lord Ayyappa part of Sri Krishna leela is said to have happened
due to Lord Siva momentarily losing control of his senses at the beauty of Lord Mahavishnus
mohini Avatara (female incarnation) to teach the males in the world the method to control their
senses. Lord Ayyappa is a Brahmachari and all men have a 41 day mandala penance every year
to follow his tenets. They are not supposed to even look at a lady. This is coming from Lord
Krishnas teachings in Bhagavadgita to practice Yatamana Yoga so that ultimately people get
control over their senses and reach him.
According to Vedic knowledge and tradition, all souls are alike and the differentiations among
beings such as genders etc., are manifestations of the Lord during creation. We, along with the
entire universe with its diversity are all creations of Lord Krishna, who is above nature (Prakruthi)
and who controls it and whose creation is not subject to Art 14 of the Constitution. We have to
accept the differentiations and diversity and respect them. All living beings are manifestations with
Lord being the inner controller. There should be no disrespect based on gender. Each living being
has to accept the body given to it and pray to the Lord with the body in the ordained way for it.
There are prescriptions made by Lord himself in the form of Agamas for enabling the humans to
pray to him. The prescriptions differ with Gender. E.g. there are several penances and worships
that are prescribed only for Women folk. These are Karva Chauth, Kaaradiaan Nombu or Maasi
Saradu (in Tamil Nadu), Vara mahalakshmi vratham, Sumangali prarthana, Paavai nombu etc.
These are not for men. For men alone there are some prescriptions likewise and there are some
for couples. It is said in Bhagavad Gita that one should stay with his own ordained duty and do
that as a worship to Lord. z z| uTm: |o ueoo @ z| u z: z| : @@ (3-35)
In the said sloka Lord Krishna says a person should only perform duties prescribed to him or her
and should not resort to doing others duties. There are some penances and worships prescribed
for women suiting their nature of Gender and some are prescribed for males suiting their gender
nature. This is done by Lord himself as per Bhagavad Gita. One should not try to perform others
prescribed duties as worship to Lord leaving his or her prescribed duties. This is the basic fabric
of Hindu religion.
Sabarimala shrine for Ayyappa is created by Lord to teach the men folk to control their
senses (It is the men who are in need for such tutoring). Hence there should not be distractions
coming there in the form of young and youthful Women folk and attempt to disturb the penance
of the deity as well as his male devotees. This should be understood by the Governments. The
age old practices and penances should not be tampered with in the name of Reform.
The above detailed explanations to the motivation behind the unique practices that have
evolved in the Sabarimala temple should answer the Top questions that were posed to the Constitution
Bench by the three judge bench of the Supreme Court.
With regards to the third question, Swami Dayananda Saraswatis "Hindu Temple Freedom
petition" in SC is pending adjudication for almost 5 years. One of the key aspects of this petition
is the wider application of the Supreme Court ratio in Chidambaram Temple Super-session of
rights of administration cannot be of a permanent enduring nature. Its life has to be reasonably
fixed so as to be co-terminus with the removal of the consequences of maladministration.
It is therefore important that the Supreme Court take up this matter before adjudicating
on the Sabarimala case as it is important to first adjudicate whether it is constitutionally permissible
for a statutory body financed under Article 290-A of the Constitution of India out of Consolidated
Fund of Kerala to manage the affairs of Sabarimala temple for an indefinite period. Whether such
unconstitutional management is infringing the rights of Ayappa devotees. Would such contributions
towards the salary of the statutory body members become a tax which is beyond the State
Governments competency to levy.
