Title IX of the Education
Amendments of 1972

No Person in the United States shall, on

the basis of sex, be excluded from
participation in, be denied the benefits of,
or be subjected to discrimination under
any education program activity receiving
Federal financial assistance.
Enacted by Congress; Signed into
law by President Richard Nixon in
June 1972

Statute is administered by the

Office for Civil Rights of the Historical
Context
Department of Education.

Title IX is typically amended

through reauthorizations of the
Higher Education Act.
Early litigation primarily addressed sex
discrimination in the funding and
support of womens athletics,
employment of women faculty and

Historical coaches, and sexual harassment.

Title IX imposes liability only on the

Context institution as an entity, not on its
individual officers, administrators,
faculty or staff as individuals.
In 2011, President Obamas Dear
Colleague Letter extended
protections based on sexual
orientation and gender identity.

Dear Colleague Letters of 2010 and Historical

2011 set forth guidelines which
institutions must follow to provide
Context
prompt due process to both the
accuser and the accused in cases of
sexual misconduct.
