Making Good Defects

Arch Can Issue An Inst To Make Good Any Defects Etc With Work That Are Due
To Work Not Being In Accordance With The Contract (17.3)
Ltd To Those That Appear After Practical Completion
Cr Must Comlpy Within Reasonable Time
Arch Must Issue A Schedule Of Defects Not Later Than 14 Days After The End
Of The Defects Liability Period

If Empr Decides To Accept A Defect It Must Clearly State So In This Schedule


And Under 17.2 A Deduction Will Be Made From The Ct Sum

Certificate

When Arch = Satisfied That All Defects Have Been Made Good He Must Issue
Certificate Of Making Good Defects Under 17.4
Defects That Appear After Issue Of Cert Of Mkg Gd But Before Final Certificate
Ct Does Not State What To Do
Should Ask Cr To Rectify, If Refuses Offset Monies In Fc
Or Get Another Cr To Fix And Ddt Cost From Fc

Nom Subs

If Defects Appear In Work Of Nom Sub, And He Fails To Rectify, Empr Must
Order New Nom Sub To Carry Out Work
He Will Be Responsible For The Costs, But Can Get The Previous Certified Costs
For The Work Refunded By The Cr
Empr Can Claim Any Costs From Original Sub-Cr
Even If Recd Final Payment, Before The Issue Of The Fin/Cert The Sub-Cr Is Still
Resp For Rectifying Defects
