ORDER

This matter came before the Court on January 22, 2018, on Defendant’s Motion to
Reduce Bond. After argument from the parties, the Court finds as follows:

The Defendant is charged with numerous cases of aggravated animal cruelty.


Defendant is a 46 year old lifelong resident of Tuscaloosa County and has no
noteworthy criminal history. His only source of income is a monthly disability payment.
The State was unable to advance any argument that would indicate the Defendant is
unlikely to appear in court to answer to these charges if bond were to be reduced.

The Court notes that release on bond pending trial is a matter of right unless a
determination can be made that doing so will not reasonably assure the Defendant’s
appearance as required.

Taking into account the foregoing, as well as the Rules of Criminal Procedure, and the
Defendant’s Constitutional right that excessive bail not be imposed, it is hereby
ORDERED as follows:

is hereby consolidated and set at $ 100,000.00. Defendant shall post a secured


appearance bond in such amount or 10% cash in lieu thereof. The Court is satisfied
that bond in such amount will address both the serious nature of Defendant’s charges
while also serving to secure his future appearance in court.

In addition to all other release conditions heretofore imposed, including the mandatory
conditions of release in Rule 7.3, the following additional release conditions are
imposed:

Defendant shall cooperate in the surrender/transfer of ownership of all of the animals


involved in these cases. Related to the transfer/surrender, Defendant shall cooperate
in executing and identifying any documents necessary to effectuate such transfer.
Finally, Defendant is prohibited from having any ownership, custody or control of any
livestock animal while on release on bond.

Any violation of the terms and conditions of release shall be grounds for revocation of
release.
