Subject: Primate’s Reference to the Appellate Tribunal

Attendance by Australian Bishops at a consecration of a bishop of the
ACNA

Date: 31 January 2018

You were advised by circular letter on 28 August 2017 that the Primate had made a
Reference to the Appellate Tribunal in regard to the attendance of Australian bishops at the
consecration of a bishop of the Anglican Church of North America (ACNA).

In November 2017 the Primate advised the Appellate Tribunal that he wished to suspend the
Reference subject to the successful outcome of mediated conversation between the parties.

The mediated conversation took place in early December 2017 and subsequently the
Primate requested the President of the Appellate Tribunal to discontinue any proceedings in
relation to the Reference.

I am writing to advise that the Hon Keith Mason AC QC, President of the Appellate Tribunal
has confirmed that the proceedings on the Reference are deemed discontinued as at 7
December 2017.

No further action will be taken on the Reference by the Appellate Tribunal.
