Title I. Preliminary Provisions
Scope Article 1
This Code governs the civil law relations between natural and legal per-
sons.

The law has no retroactive effect unless its wording or purpose provides
otherwise.

Abuse of right Article 5
One cannot exercise one’s right in a manner contradictory to its social
and economic purpose or the principles of community life. Acting or
refraining from acting by an entitled person is not deemed an exercise of
that right and is not protected.
Burden of proof Article 6
The burden of proving a fact lies with the person who draws legal effects
from that fact.
Presumption of good faith Article 7
If the law makes legal effects contingent upon good or bad faith, good
faith is presumed.

§ 1. Every human being has legal capacity from the moment of birth.

When a child is born it is presumed that it is born alive.

Age of majority Article 10
§ 1. An adult is any individual who has attained eighteen years of age.
§ 2. A minor becomes an adult on marriage. He does not lose that status
in the event of the marriage being annulled.
Full capacity for legal acts Article 11
Full capacity for legal acts is acquired at the moment of becoming an
adult.
No capacity for legal acts Article 12
Individuals who have not attained thirteen years of age and persons fully
legally incapacitated do not have capacity for legal acts.
Full legal incapacitation Article 13
§ 1. A person who has attained thirteen years of age may be fully legally
incapacitated if, due to mental illness, mental retardation or other mental
disorder, in particular alcoholism or drug addiction, he is incapable of
controlling his behavior.
§ 2. A guardian is appointed for a fully legally incapacitated person un-
less the person is still under parental authority.
Effects of no capacity for legal acts Article 14
§ 1. A legal act performed by a person who does not have capacity for
legal acts is invalid.
§ 2. However, if a person who does not have capacity for legal acts ex-
ecutes a contract of a type commonly executed in minor current day-
-to-day matters, this contract becomes valid the moment it is performed
unless it causes serious harm to the person who does not have capacity
for legal acts.
Limited capacity for legal acts Article 15
Minors who have attained thirteen years of age and persons partially le-
gally incapacitated have limited capacity for legal acts.
Partial legal incapacitation Article 16
§ 1. An adult may be partially legally incapacitated due to mental illness,
mental retardation or other mental disorder, in particular alcoholism or
drug addiction, if his condition does not justify him being fully legally
incapacitated but he requires assistance to manage his affairs.
§ 2. A curator is appointed for an individual partially legally incapaci-
tated.
