The Complainant submits this complaint to the Court and states that there is probable cause to believe
Defendant committed the following offense(s):

Charge Description: On or about July 15, 2017, in the County of Ramsey, Minnesota, the defendant,
Nicholas Charles Barghini, did engage in sexual contact with another person, under the age of 13 years,
while more than 36 months older than the complainant.

STATEMENT OF PROBABLE CAUSE 11/17/2017 09:59:05 AM

On July 31, 2017, NICHOLAS CHARLES BARGHINI (DOB: 06/01/1986) was charged with two counts of
Criminal Sexual Conduct in the Fifth Degree for engaging in masturbation in the presence of a minor under
16 years of age in Ramsey County District Court File numbers 62-CR-17-5666 and 62-CR-17-5700. 

Investigation into those offenses revealed that Barghini, while representing himself as an “acting instructor,”
took advantage of the opportunity to be alone with young girls.  Barghini instructed the girls to lie down on a
couch with their shoes and socks off.  He then positioned himself at the end of the couch, played with their
feet, and masturbated. 

A search warrant was executed at Barghini’s residence where an external hard drive was recovered.

Between 2:00 and 4:00 PM on July 15, 2017, RS brought her daughter, NPS (YOB: 2006), to the Merriam
Park Library located at 1831 Marshall Avenue, Saint Paul, Ramsey County to participate in an acting class
with Barghini. 

Further investigation into the above-referenced matters revealed that on July 15, 2017, while holding an
“acting class” at Merriam Park Library, Barghini sexually assaulted NPS. 

A video recovered from Barghini’s external hard drive was saved under NPS’ first name.  The video shows
that NPS was instructed to recite her monologue during the “class.”  No one was allowed in the room while
Barghini was working with NPS.  The video shows Barghini instructed NPS to lie on her stomach across a
row of wooden chairs and place her feet in his lap.  Barghini then instructed the girl to recite her monologue
while he tickled her feet.  The girl followed his instructions. 

While NPS was reciting her monologue, Barghini pulled his penis out of the side of his shorts and he
began to masturbate with one hand while simultaneously tickling NPS’s foot with the other hand. 
Approximately one minute after he began masturbating, he touched his penis against the bottom of one of
NPS’s feet and proceeded to rub his penis against her foot.  He also rubbed his penis against her toes. 
After approximately 35 seconds of rubbing his penis on the bottom of her feet and her toes, Barghini
ejaculated. 

Barghini is seen in several other self-made videos touching the feet of a child with his hands, placing his
mouth on the feet of a child, exposing his penis in the presence of a child and placing his penis on the foot
of a child. 

On August 21, 2017, police spoke to a representative of Breakthrough Twin Cities who said that Barghini
had inquired about volunteering with the program which is a college prep course helping 6 – 12 graders.

NOTICE: Pursuant to Minnesota Statute 609.49, subd. 1 (a) A person charged with or convicted of a felony
and released from custody, with or without bail or recognizance, who intentionally fails to appear when
required after having been notified that a failure to appear for a court appearance is a criminal offense, or
after having been released on an order or condition that the releasee personally appear when required with
respect to the charge or conviction, is guilty of a crime for failure to appear and may be sentenced to not
more than one-half of the maximum term of imprisonment or fine, or both, provided for the underlying crime
for which the person failed to appear, but this maximum sentence shall, in no case, be less than a term of
imprisonment of one year and one day or a fine of $1,500, or both.

determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest

pending further proceedings. Defendant is therefore charged with the above-stated offense(s).
