D. GROUNDS OF APPEAL:
1. The decision is contrary to the law, the evidence and the weight of the evidence and is an
unreasonable verdict;
2. The learned trial Justice erred in law in failing to admit evidence of previous sexual
activity between the Appellant and the complainant.
3. The failure of Crown counsel to control her witness during examination in chief to
prevent the jury from hearing inadmissible and egregiously prejudicial information necessitated
that a mistrial should have been declared.
4. The learned trial Justice incorrected tempered the Appellant’s examination, thereby
excluding evidence favourable to the Appellant.
5. Such further and other grounds as counsel may advise and this Honourable Court may
allow.
