GOVERNOR RILEY AND COMMANDER TYSON’S RESPONSE TO


PLAINTIFFS’ MOTION TO CLARIFY SCHEDULING ORDER
Governor Riley and Commander Tyson respectfully oppose Plaintiffs’

motion to clarify and reconsider (Doc. 16) this Court’s scheduling order on the

Governor and Commander’s motion to dismiss to the extent that Plaintiffs are

requesting this Court to also set a hearing on their motion for a preliminary

injunction. The Governor and Commander have moved to dismiss this entire

action under Rule 12(b)(6) (Doc. 13), and this Court’s order sets a briefing

schedule and hearing for that motion. In light of the points raised in that motion to

dismiss, it would be contrary to the interests of both federalism and judicial

economy to proceed with briefing and a hearing on Plaintiffs’ motion for

preliminary injunction before this Court addresses and resolves the Governor and

Commander’s motion to dismiss.
