AFFIDAVIT OF DESISTANCE

I, JOY ANG GOBONSENG, of legal age, Filipino, married and a resident of Dumaguete City,
Philippines, after having been sworn to in accordance with law do hereby depose and say:

1. That I am an MCH driver plying within the territorial jurisdiction of Dumaguete City of which the said
MCH particularly described as follows:

1. That on August 25, 2009, at or about 11: o’clock in the morning while driving the above-mentioned
MCH on my way to Real St, heading North direction, I lately discovered at the west side shoulder of
the road I accidentally hit and bumped the motor vehicle driven by a certain Roy Ang Gabonseng and
I tried to maneuvered well my driven MCH and applied a break but to my dismay, I still bumped and
hit the same which caused some damages to be determined by a mechanic;

2. That the above-mentioned motorized tricycle-for-hire is owned and operated by Mario Duran;

3. That after arriving to a compromise agreement with the owner of the motorized tricycle-for-hire and
the driver relative to the expenses incurred for the repair of my driven service vehicle, I have come to
realized that accidents do happen and knowing that this particular incident is purely unintentional I
have given the situation my full understanding and humane consideration;

4. That in view of the foregoing, I hereby declare that I am no longer interested in pursuing the
prosecution of a case against Jose Vilan y Balahan in any criminal action arising or which may arise by
reason of the aforesaid accident;

5. That I have not been threatened, coerced nor forced with physical harm and violence in the execution
of this Affidavit of Desistance.

AFFIDAVIT

I, LEONARDO T. AVERIA, of legal age, Filipino, married and a resident of Brgy.

Banilad, Dumaguete City, Philippines, after having been sworn to in accordance with law do
hereby depose and say:

1. That I am a holder of passport duly issued by the Department of Foreign Affairs

(DFA) of Cebu City sometime in 1995;

2. That on March 22, 2004, I submitted the aforementioned passport to the

Department of Foreign Affairs (DFA), Manila for its renewal since it had already expired;

3. That after I had submitted the above-mentioned passport to the Department of

Foreign Affairs, Manila on the aforesaid date, I was issued a new passport (renewed) bearing
Passport No. MM759856 by the said agency;

4. That after it has been issued by the said agency, I requested my nieces to follow-
up and get the said passport for me, however, they were not able to get it in my behalf, at the
same time, failed to inform me that my passport was not released by the Department of Foreign
Affairs to them;

5. That until now, I believe, said passport is still in the Department of Foreign
Affairs, Manila;

6. That I am executing this affidavit to attest to the truth and veracity of the
foregoing declarations and to support my claim and release of my renewed passport in the
Department of Foreign Affairs (DFA), Manila, and to support whatever legal purposes this may
lawfully served.
