A F F I D A V I T OF WITNESS

I, KARL IVAN MILLER IBARRA, thirteen (11) years old,

single, and a resident of 1st Crumb Street, Digos City, Davao del Sur,
Philippines, after having been sworn to in accordance with law, do
hereby depose and state that:

1. That I personally know the herein petitioner in this case

NICOLETTE SANTOS HENDERSON as my stepmother, the legal
husband of my father KEVIN IBARRA HENDERSON;

2. When I was seven (7) years old, my father and my stepmother

decided to live together with me and my brother KENT IVAN ARNAIZ
IBARRA in Emily Homes Subdivision, Digos City, Davao del Sur,
Philippines;

3. At first, NICOLETTE SANTOS HENDERSON was very good

to us and treated us as her own children. But after sometime she was
already showing signs of hostility towards us. When we commit small
mistakes, she would either pinch us or pull our hair;

4. Then I noticed that she was becoming ill tempered. There are
times that she would be so mad at us for no reason. Then one time
she was very upset with the glass that my brother KENT IVAN
ARNAIZ IBARRA accidentally broke. I begged her to stop but she
still was very anxious and locked him up half of the day. She
threatened us that if ever we will tell our father of the incident, she
will starve us and scold us more;

5. The physical, psychological and emotional maltreatment

and abuse aggravated as my father’s business was expanding. They
decided to hire a house help in order to assist my step mother. I can
still remember when she would authorize the house help to inflict
corporal punishment to us children and to verbally abuse us in her
absence. When we remiss on our assigned household chores when she
is around, she would scold us real hard and physically hurt us;

6. That oftentimes, she would be so jealous towards our father

even when the calls are business related. She would throw a fit on very
small and trivial matters causing an argument and fight between the
two of them sometimes even in our presence.

7. That when the doctor told her that she will be forever a barren,
she went so mad and drove me, my father and my brother out of the
house;

I executed this affidavit to attest the truthfulness of the foregoing

facts and to support the defense of my father KEVIN IBARRA
HENDERSON against the case filed by NICOLETTE SANTOS
HENDERSON for violation of Republic Act No. 9262 or “Anti-Violence
Against Women and Their Children Act of 2004”, specifically Sections
5(a) and 5(i).
