AFFIDAVIT OF WITNESS

I, BENJAMIN LARA, of legal age, married and a resident of Estrada Street,

Zamboanga City, after having been duly sworn to in accordance with law hereby
depose and state:

1. That I am a member of the Philippine National Police since 2002 with the rank
of Senior Police Officer 2 and is assigned in Police Crime Laboratory (Scene of
the Crime Operatives), Camp General Batalla, Cawa-Cawa, Zamboanga City .

2. That on November 22, 2016, I was on a twenty-four (24) hour duty and it will
end at 8:00 A.M. the following day November 23, 2016;

3. That around 3:00 A.M. in the morning of November 23, 2016, we got a call
from Sta. Maria Police Station asking a dispatch on the shooting incident in
Ruby Street, Villa Asuncion Subdivision, Pasonanca, Zamboanga City.
Record of such call was log in our logbook as standard operating procedure.

4. That along with my team, we went to Ruby Street, Villa Asuncion

Subdivision, Pasonanca, Zamboanga City. When we reached the area, there
were already policemen from Sta. Maria Police Station.

5. We immediately proceeded to the kitchen as we were directed by SPO3 Jhay

Ar. There was already police yellow tape in the scene of the crime. As
standard operating procedure, we took pictures of the scene of the crime.

6. In the crime scene, there were plates broken near the table which is located
near the entrance door of the dirty kitchen. Some pots were on the floor.
Approximately a meter away from the door, on the floor, two spots of blood
were found.

7. The samples of the spots of the blood were taken and were sent to the Crime
Laboratory for testing. The result indicated that said blood is blood type “A”
which is the blood type of Pedro.

8. We also recovered the gun and fingerprints were taken. When fingerprints
were sent to the lab, the result shows that there were two fingerprints.
Fingerprints of Juan dela Cruz and Pedro Nagiba were found in the gun.

9. That I am executing this Affidavit to attest the truthfulness of the foregoing

facts.
