I am a former Assistant Attorney General who has also managed a title insurance company as
11
a title insurance producer. I have also practiced First Amendment and Civil Rights Law throughout
12
the 1990’s, routinely running video of said trials in an age before broadband. Prior to those
13
activities I was an editor and reporter for mid-sized and large daily press. This week my TV Show
14
“Corruption Meets Camera” airs on VH2 Networks/Roku TV.

I have run video since 2010 in courtrooms throughout the Country -- including Courts of
16
Record in the States of Wisconsin, Ohio, Washington, New Hampshire, Massachusetts and more --
17
on murder trials, civil litigation and foreclosure without incident including countless King County
18
Courtrooms, completely without incident. I also shoot and produce raw Deposition videos.

KingCast and Mortgage Movies employs my legal background and experience as a licensed
20
title insurance producer, escrow attorney and Civil Rights attorney to comment on and to analyze
21
legal matters; all footage shall be made available for media pooling orders or requests in this

regard.

MEMORANDUM OF LAW

There should be absolutely no need for a Memorandum on Law in this matter, but because
3
of a particular Washington State Judge (Stanley Rumbaugh) and his contempt for the First
4
Amendment I will provide some context that must be noted for this Honorable Court.
5
First, I note that I cannot find any supporting case law that would allow this Court to deny
6
my request, or the request of my brothers and sisters at Liberty’s Champion other than the case
7
against Judge Rumbaugh that three of us lost last year amidst a flurry of complete falsities set forth
8
by the ethically-challenged Pierce County Prosecutor’s Office. They even claimed that they were
9
not aware that I was shooting video pursuant to a First Amendment/Reporter’s intent – even though
10
that analysis should not even be necessary under the Rule.

In point of fact, Washington State 2010 Judge of the Year Frank E. Cuthbertson hails from
12
Pierce County and he made it absolutely clear that one need not be a news journalist in order to
13
enjoy the protections of GR 16 in his MEDIA ORDER of 31 October, 2012. That request was
14
issued by an entity working on a documentary movie in point of fact. See Appendix A for an apt
15
comparison between His Honor and Defendant Rumbaugh.

In point of fact, as noted by Counsel for Liberty’s Champion, in Obsidian Finance Group,

LLC v. Cox, 740 F. 3d 1284, 1291 (9th Cir. 2014) the Court noted “[t]he protections of the First Amendment
19 do not turn on whether the defendant was a trained journalist, formally affiliated with traditional news

20 entities, engaged in conflict-of-interest disclosure, went beyond just assembling others' writings, or tried to

get both sides of a story”)…..”

While Plaintiff is indeed a trained journalist who has also won First Amendment Jury Trials, he is
2 entitled to no more or less protections than ABC News or a well-behaved private citizen holding up a cell

3 phone in a Courtroom. The only distinction could be that I am making footage available in a professional

capacity for media pools so perhaps I get the corner where a tripod would sit. But that’s it folks. That is the
4
Law and any other approach can and will result in litigation. The integrity of this Country’s legal system
5
and the Fourth Estate demands it.
