CONDITIONAL CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT made and entered into in Butuan City City, Philippines, this _____day of
______________, 200__ by and between:

________________, a nonstick nonprofit housing ministry created and existing under the laws
of the republic of the Philippines, with office at BCLDS< JC Aquino Avenue, Butuan city, represented
herein by its President MRS. JOWENA JAN M. HIPONIA by virtue of BOD Resolution No. ____
series of 2009 hereinafter referred to as the HABITAT
--and—

_______________ of legal age, Filipino, with residence and postal address

Block__Lot__Lopez Habitat Village, Purok 5, Baan, Butuan City and herein after referred to as the
HOMEPARTNER.

WITNESSETH: THAT

WHEREAS, the homepartner would like to avail the Habitat house and lot at Baan3, Butuan
City through PAG-IBIG;

WHEREAS, HABITAT is willing to grant the HOMEPARTNERS request

NOW THEREFORE, for and in consideration of the foregoing premises, the HABITAT
agrees to sell and the HOMEPARTNER to buy the above described house & lot under the following
terms and conditions.

1. The HOMEPARTNER shall apply for a lot purchase and house construction loan with PAB-
IBIG in the amount of __________ to pay HABITAT for the house and lot. The
proceeds/check of the PAG-IBIG loan shall be paid to and in the name of BUTUAN
HABITAT FOR HUMANITY, INC.
2. For purposes of the loan, HABitat shall allow the transfer of the title in the name of the
HOMEPARTNER but only after the issuance of a letter of guarantee from PAG-IBIG.
3. That after receipt of the payment, HABITAT shall start house construction in accordance
with the approved plans, procedures and specifications.
4. All expenses, such as capital gains tax, transfer tax, documentary tax, notaial fees, real
property tax, etc., shall be to the account of the HOMEPARTNER

This Contract shall be binding upon the heirs, successors, executors, administrators and assigns
of the respective parties hereto.

I certify that on this date, before me, notary public duly authorized in the city name above to

take acknowledgments, personally appeared the abovenamed persons, who were identified by me
through competent evidence of identity to be the same persons described in the foregoing instrument,
who acknowledge before me that their respective signatures on the instrument were voluntarily affixed
by them for the purposes stated therein, and who declared to me that they have executed the instrument
as their free and voluntary act and deed and that they have authority to sign on behalf of the respective
principals.

The foregoing instrument is a Conditional Contract to sell covering the abovementioned

property
