Dear Governor Snyder:

While I appreciate your recent emergency rules superseding Emergency Rule 19, I am troubled by the
impact that this will have on temporarily operating businesses who have relied on that rule for months.
Specifically, I am concerned about new Emergency Rule 2(5), which states that if an applicant “does not
submit a complete marihuana facility license application [by] no later than June 15, 2018, then the
temporary operation may be used as a reason for denial of a license…” Unfortunately, many
municipalities – particularly those in larger cities like Lansing - have not completed their medical
marihuana facility licensing process, and, consequently, have yet to provide their municipal applicants
with an Attestation I, which is required to submit a complete marihuana facility license application. As
such, many temporarily operating businesses throughout our communities and the State will be forced to
shutter, leaving many employees jobless and many medical marihuana patients without reliable access to
the substance that provides them palliative relief from their debilitating medical conditions.

I respectfully request that you issue a new emergency rule to supersede Emergency Rule 2(5) and to set a
future deadline rather than ex post facto deadline for submission of the phase two marihuana facility
license applications in order to allow more municipalities to complete their licensing process, provide the
Attestation I’s to the businesses that have been waiting for them and to ensure that medical marihuana
patients are protected.
