NOTICE OF VIOLATION

RE: Life Safety Inspection – Rochester Fair Exhibition Building

On Tuesday September 25, 2018 a life safety inspection was performed of the exhibition building
located on your property at 72 Lafayette Street. Our records and observations lead us to classify your
occupancy as an existing place of assembly within a type V (000) building. The following violations were
noted during the inspection.

1. NFPA 101 (2015) Section 7.2.1.4 – The code has requirements for the swing orientation and
force to which a door in a means of egress operates. All doors as part of the means of egress
shall comply, all were found to be deficient.

2. NFPA 101 (2015) Section 13.2.2.2.3 – All exits must be equipped with panic hardware. As such
the existing hasps and latches would need to be removed.

3. NFPA 101 (2015) Section 7.1.6.3.1 – The walking surface in the agricultural room shall be
leveled.

4. NFPA 101 (2015) Section 7.2.5 – The ramp in the scout room shall comply with this standard for
slope and construction. The handrails must also be compliant.

5. NFPA 1 (2009) Section 11.1.7.6 – Extension cords shall not be used in lieu of permanent wiring.
All extension cord use being utilized in this manner shall be discontinued and permanent wiring
installed in its place.

6. NFPA 72 (2013) Section 10.6.5.4 – The circuit breaker powering the fire alarm control panel
must have a listed breaker lock attached to it per this section of the code.

7. NFPA 1 (2009) Section 10.19.5.1 – Discontinue storage in mechanical and electrical rooms.
Combustible material shall not be stored in boiler rooms, mechanical rooms, or electrical
equipment rooms

8. NFPA 101 (2015) Section 11.1.5.2 – The use of multi tap adapters shall discontinue per this
section.

9. NFPA 1 (2009) Section 50.1.1 – All commercial cooking equipment shall comply with chapter 50
and NFPA 96. This applies building wide, specifically the pizza oven located in the corner kitchen
and the small kitchen located in the back of the building.

10. NFPA 101 (2015) Section 10.1.1.2 – A K-Type extinguisher is required within 30 feet of any
combustible cooking media.

11. NFPA 101 (2015) Section 7.8.1.2 – All means of egress must be continually illuminated and per
7.9.2.1 emergency illumination of the same means of egress shall be provided for not less than
90 minutes.

12. NFPA 101 (2015) Section 13.2.10.1 – All means of egress shall be equipped with illuminated
egress signs.

13. NFPA 101 (2015) Section 4.5.8 – Multiple emergency lighting units and exits signs failed testing
during the inspection. These units must be restored, repaired, or replaced.

14. NFPA 101 (2015) Section 10.2 – Interior finishes are non-compliant and must meet the minimum
requirements of this section.

15. NFPA 101 (2015) Section 10.2.5.1 – During the fair it was noted that wall coverings by vendors
exceeded the allowable amount established by this section. Compliance will be required ahead
of next year’s fair.

16. NFPA 101 (2015) Section 8.7 – The church booth shall be rated with a one hour rating or
sprinklers installed as it has a gas fired appliance in it.

17. NFPA 101 (2015) Section 13.3.4.1.1 – Per this section the building requires an NFPA 72
compliant fire alarm system. The current system does not meet the minimum requirements.

18. NFPA 101 (2015) Section 13.3.5.2 – The building currently is not protected by a sprinkler system.
Per this section the building shall be protected throughout by an automatic sprinkler system.

19. NFPA 1 (2009) Section 10.4.1 – Submit documentation showing that the current fire alarm
system installed in the building has been maintained, inspected, and tested in accordance with
NFPA 72 (2013).

20. NFPA 1 (2009) Section 19.2.1.1.1 – All rubbish containers larger than 40 gallon require lids. No
lids were found for any of the containers.

21. NFPA 1 (2009) Section 10.12.1 – New and existing buildings shall have approved address
numbers placed in a position to be plainly legible and visible from the street or road fronting the
property.

22. NFPA 1 (2009) Section 18.2.2.1 – The fire department key box was found to not have adequate
keys for access to all building on site. Please provide those for the key box.

Because of the scope and complexity of the fire and life safety code violations relative to the sprinkler
system, fire alarm and egress components we will require a comprehensive plan from you that details
how the building will be brought into code compliance. This plan must be developed by, or reviewed
and signed by, a New Hampshire state licensed fire protection engineer. We will need proof that these
deficiencies are being addressed within thirty days of this violation letter. Whereas it is reasonable to
assume that it may take longer than the thirty days to resolve some of the deficiencies as well as
establish a plan of correction through a fire protection engineer, we may accept a letter of confirmation
from your contracted fire protection engineer that details the timetables for completion on their report.
The timetables must be agreed upon by the fire department.

We expect to hear back from no later than November 9, 2018.
