WHEREAS, the old law or Republic Act No. 4136 otherwise known as the "Land
Transportation and Traffic Code" signed into law on June 20, 1964, is the law that governs
among others, the speed limit of all motor vehicles in the Philippines~

·WHEREAS, Section 35 of RA 4136, states that: Any person driving a motor vehicle on
a highway shall drive the same at a careful and prudent speed, not greater nor less than is
reasonable and proper; having due regard for the traffic, the width of the highway, and of any
other condition then and there existing; and no person shall drive any motor vehicle upon a-

highway at such a speed as to endanger the life, limb and property of any person, nor at a speed
greater than will permit him to bring the vehicle to a stop \vithin the assured clear distance ahead.;

WHEREAS, Republic Act No. 7160 otherwise known as the Local Government Code
of 1991, however, grants the local government units the power to regulate traffic on all streets
and bridges within their territorial jurisdiction, and to enact such measure that will enhance the
public health, safety, convenience, rnaiotain peace and order, and promote the general welfare of
its inhabitants;

WHEREAS, due to the numerous road incident in the City of Iloilo which caused
physical injuries, damage to property and even death, there is a need to regulate the speed limit
within its territorial jurisdiction to minimize if not totally eliminate these incidents.

NOW, THEREFORE, be it ordained, by the City Council, that:

Section I. Title - This Ordinance shall be known as "AN ORDINANCE AMENDING


REGULATION ORDINANCE NO. 2015-283 OTHERWISE KNOWN AS AN
ORDINANCE PROVIDING FOR THE SPEED LIMITS FOR ALL KINDS OF MOTOR
VEIDCLES WITHIN THE TERRITORIAL JURISDICTION OF ILOILO CITY AND
PROVIDING PENALTIES FOR VIOLATION THEREOF."

Section 2. Purpose. - It is the purpose of this ordinance to safeguard public safety and
ensure the we}} being of all its constituents by protecting them from road accidents· due to over
speeding and reckless driving.

Section 3. Coverage. - This ordinance shall apply to all types of public motor vehicle
and to its drivers and owners within the territorial jurisdiction of Iloilo City.

Section 4. Definition of Terms. - As used in this Ordinance, the terms below shall have
the meaning ascribed to them in this section, adapting some of the definition provided for in R.A.
4136. Any words or terms not defined shall be given their plain and customary meanings, unless
the context requires otherwise, and shall be interpreted in a manner consistent with the purpose
and spirit of this ordinance.

(a) "Speed limit" - the maximum speed at which a vehicle may legally travel on a

( particular stretch of road.

(b) "Driver" - shall mean every and any licensed operator of a motor vehicle.

( c) "Owner" - shall mean the actual legal owner of a motor vehicle, in whose name such
vehicle is duly registered· with the Land· Transportation Com·mission.

The "owner" of a government-owned motor vehicle is the head of the office or the chief
of the Bureau to which the said motor vehicle belongs.

(d) "Motor Vehicle" - shall mean any vehicle propelled by any power other than
muscular power using the public highways, but expecting road rollers, trolley cars, street-
sweepers, sprinklers, lawn mowers, bulldozers, graders, fork-lifts, amphibian trucks, and cranes
if not used on public highways, vehicles which run only on -rails or tracks, and tractors, trailers
and traction engines of all kinds used exclusively for agricultural purposes.

Trailers having any number of wheels, when propelled or intended to be propelled by


attachment to motor vehicle, shall be classified as separate motor vehicle with no power rating.

(e) "Passenger automobiles" - shall mean all pneumatic-tire vehicles of types similar to
those usually known under the following terms: touring car, command· car, speedster, sports car,
roadster, jeep, cycle, car (except motor wheel and similar small outfits which are classified with
motorcycles), coupe, landaulet, closed car, limousine, cabriolet and sedan.

Motor vehicles with changed or rebuilt bodies, such as jeepneys, jitneys, or station
wagons, using a chassis of the usual pneumatic-tire passenger automobile type, shall also be
classified as passenger automobile, if their net allowable carrying capacity, as determined by the
Commissioner of Land Transportation, does not exceed nine passengers and if they are not used
primarily for carrying freight or merchandise.

The distinction between "passenger truck" and "passenger automobile" shall be that of
common usage. Provided, That a motor vehicle registered for more than nine passengers shall be
classified as "truck": And Provided, further, That a "truck with seating compartments at the
back not used for hire shall be registered under special "S" classifications. In case of dispute. the
Commissioner of Land Transportation shall determine the classification to which any special
type of motor vehicle belongs.

Section 5. Speed Limit. - The rate of speed of all types of motor vehicles within the
territorial boundaries oflloilo City. shall be the following:

Section 6. Implementing Agency. - The Iloilo City Traffic Management and


Transportation Regulation Office (TMTRO), in the discharge of their official functions,
~ shall serve as the implementing agency of this ordinance in coordination with the lloilo City
-~ Police Off"ree. Furthermore, the TMTRO is mandated to comply with the existing

ordinance on the issuance of citation tickets. The Iloilo City Legal Office shall be in charge
in the pFeparatio.o and filing o.f the case in Co.art.

Section 7. Road Signs. - The City Engineers Office with the proper coordination of
the Iloilo City Traffic Management and Transportation Regulation Office (TMTRO) shall
be responsible in putting up the required maximum speed road signs within the City of
Iloilo,. in accordance with the international standards on signs and symbols.

Section 8. Budget Allocation. - The Iloilo City government shall allocate the necessary
funds for the purchase of the device to be used to measure the speed of the moving vehicles.

Section 9. Penalty. - The driver, after due hearing, is liable for failure to comply with
the speed limit imposed under this ordinance.

For the first offense - P 200.00 and/or imprisonment of 1 day minimum to


2 months and 1 day maximum at the discretion of
the court

For the second offense - P 500.00 and/or imprisonment of2 months and 1
day minimum at the discretion of the Court.

For the third offense - P 1,000.00 and/or imprisonment of 4 months


and 1 day minimum to 6 months maximum at
the discretion of the court.

Section 10. Exceptions. - The rates of speed hereinabove prescribed shall not apply to
the following:

(1) A physician or his driver when the former responds to emergency calls;

(2) The driver of a hospital ambulance on the way to and from the place of accident or
other emergency, provided the vehicle is indeed bringing patient/s or responding to
emergency cases;

(3) Any driver bringing a wounded or sick person for emergency treatment to a hospital,
clinic or any other similar place, provided the driver shall switch on the hazard lights;

L / (4) The driver of a motor vehicle belonging to the Armed Forces while in use for official
purposes in times of riot, insurrection or invasion~

(5) The driver of a vehicle, when he or his passengers are in pursuit of a criminal;

(6) A law enforcement officer who is trying to overtake a violator of traffic laws;

(7) The driver officially operating a motor vehicle of any fire department, in response to
the Fire call;

(8) For security reasons, very important persons (VIPs) such as visiting National
Government Officials and other dignitaries;

(9) Vehicles of Media responding to the incident reports/covering running reports.

Section 11. Oversight Committee. - There shall be created an Oversight Committee to


oversee and monitor the implementation of this ordinance and thereby make a1 recommendation
to the City Council and the Mayor relative to the implementation of this ordinance. The Mayor
through the Executive Order shall create the Committee and designate the members.

Section 12. Separability Clause. - If for any reason, any pro ision, section or part of
this ordinance is declared unconstitutional or not valid by a court of ompetent jurisdiction, or
suspended by competent authority, such judgment shall not affe or impair the remaining
provisions, sections or parts which shall continue to be in full force an effect.

Section 13. Repealing Clause. - All ordinances, rules and regulations, executive orders,
proclamations and administrative regu1ations, or parts thereof, which are inconsistent with any
pmvisi<>n <>f this 1>rdinance are hereby repealed <>r modified acrnrdingly.

Section 14. Effectivity. - This ordinance shall take effect after its publication in a
newspaper of general circulation in Iloilo City.
