CONTRACT FOR SECURITY GUARD SERVICES

AT FRATERNITY EVENT

A photocopy of this contract, completed and signed by all parties, must be turned into the
Center for Fraternity & Sorority Life no later than 4:00 p.m. on the Friday of the weekend of the
event. It can be hand delivered, faxed to (619) 59-1045, or mailed to Center for Fraternity &
Sorority Life, San Diego State University, 5500 Campanile Drive, MC 7445, San Diego, CA
92182-7445.

This agreement made this ______ day of __________________ 20____, by and


between the ______________________ Chapter of __________________ Fraternity
hereinafter referred to as “Fraternity” and _____________________, an independent
contractor, hereinafter referred to as “Security Company”.

WITNESSETH: That in consideration of the mutual covenants and agreements to be


kept and performed on the part of said parties hereto, respectively as herein stated, the
said Fraternity does hereby covenant and agree that it shall:

1. Pay the Security Company $ ________ per hour for ______


security persons for a minimum of ______ hours, to be paid by check,
payable to _________________________, at the conclusion of the
event.

2. Abide by all rules and regulations established by San Diego State


University and the San Diego State University Interfraternity Council or
United Sorority and Fraternity Council, as appropriate, regarding
parties and social events, as stated in the document “SDSU Fraternity
Social Event Management Policies” (attached hereto), including but
not limited to policies governing alcohol, wristbands, and guest lists,
and agrees to cooperate with the Security Company so that Security

Company can carry out the prescribed duties (defined below), and be
allowed to do so.

3. Provide a list of at least two Fraternity officers who shall serve as the
designated Fraternity representatives for the event and ensure that the
designated Fraternity representatives are accessible and available throughout
the duration of the function to assist the Security Company in carrying out the
prescribed duties (defined below).

II. And said Security Company covenants and agrees that it shall:

1. Be currently listed and in good standing with the Bureau of Security


and Investigative Services in Sacramento, CA, and upon request
provide proof of bonding and licensing and current insurance certifying
a liability policy of no less than $1,000,000.

2. Arrive at [street address] ___________________________, San


Diego, California, on [day, date] _____________,
_________________, 19 ____ wearing the uniform of the Security
Company. The Security Company shall supply the guards with a
flashlight and a cellular telephone. While present, the Security
Company’s guards shall maintain a check station at the entrance to the
function where: (a) driver’s licenses or state-issued identification cards
can be checked for age, (b) the appropriate wristband given out (white
for under 21 and other colors for legal drinking age), (c) bags or
satchels will be checked for bottles and alcohol spilled out if underage,
(d) names will be compared with those on the guest list, (e) no one
shall be admitted after the wristbands assigned for the party have been
distributed, (f) no person shall be admitted with more than a six-pack of
12 ounce beers (two persons over 21 years of age arriving together
may share a twelve-pack), (g) no person shall be admitted with hard
liquor/distilled spirits, and (h) all beverages in the possession of those

admitted must be in original, unopened containers (beverages in cups,
tumblers and containers that have been opened shall be poured out).
No less than 1 (one) security guard shall maintain this station at all
times. Whenever possible, these guard(s) will also help to control those
individuals that are waiting to enter the function in the event that these
individuals become unruly, or call San Diego State University Police if
the situation is beyond the guard(s) safe capability.

3. At least 1 (one) guard shall be assigned to patrol the premises to


make sure all present are wearing wristbands, check for underage
drinking, check for bottles, check for cups and tumblers, and to deal
with any potential problems that the fraternity may require assistance
dealing with requiring the expertise of the security guard. This will
include, but not be limited to the break-up of minor disputes,
confrontations, verbal and physical assaults, unless such assaults
require police assistance and then to take reasonable measures to
maintain control until the San Diego State University Police arrive. In
any situation(s) where the guard(s) feels that additional assistance is
required, the guard(s) will call the San Diego State University Police
(594-1991) for assistance. If the San Diego State University Police are
unable to respond or require backup, the City of San Diego Police will
be contacted. The guards employed by and representing the Security
Company will be given the authority to confront identified underage
drinkers and dispose of the alcoholic beverage, or after more than one
occurrence involving the same individual in the same evening, escort
the individual off the premises. Likewise, the guards will be given the
authority to confront anyone present at the party with a cup, tumbler or
sports bottle and dispose of the beverage, or or after more than one
occurrence involving the same individual in the same evening, escort
the individual off the premises. If underage drinking or consumption of
hard alcohol appears to be widespread or if there is a common source
of alcoholic beverages, the guard(s) will contact a designated Fraternity

representative to rectify the situation. If the situation is not rectified, the
guard shall contact the SDSU Police and request that the party be
closed down. The patrolling guard(s) will also make sure that no one
enters or leaves by any way other than the specified entrance and exit.
If anyone is caught entering the function by other than the specified
entrance, the individual will be escorted from the premises.

4. Agree to support and enforce any other relevant policies included in


the State University Interfraternity Council or United Sorority and
Fraternity Council policy regarding parties as stated in the document
“SDSU Fraternity Social Event Management Policies” (attached hereto)
where applicable.

5. At the end of the function notify a designated Fraternity


representative and all guards will help close down the party and
disperse the crowd from the Fraternity’s premises and adjacent
sidewalks and streets, leaving only Fraternity members and their
personal guests. Once the crowd has been dispersed, the guards will
then be dismissed.

6. Cooperate and comply with instructions from the San Diego State
University Police and the City of San Diego Police.

7. In the event action is instituted for the enforcement of any term or


condition of this contract, the prevailing party shall be entitled to an
award of reasonable attorneys fees in said suit, in addition to costs and
reasonable expenses incurred in the prosecution of said suit.

This agreement shall be binding upon the parties, their successors, assigns and
personal representatives. Time is of the essence on all undertakings. This agreement
shall be enforced under the laws of the State of California. This is the entire
agreement.
