CASE STUDY

V.P. Shantha’s husband was admitted in the Cosmopolitan Hospital. They did not charge for treatment
of her husband. Due to the negligence of medical services of that hospital, he died. She filed complaint
against it. The Hospital authorities contended that they rendered free medical service. On appeal, the
National Commission gave the judgement dated 3-5-1993 in OP No. 93 of 1992, holding the Hospital
was not liable since the treatment was given to the complainant’s deceased husband in the nursing home
belonging to the opposite party was totally free of any charge, and it did not constitute ‘service’ as
defined under the Act and the complainant was not entitled to seek any relief under the Act.
