SPECIAL REQUIREMENT (General)

Bidder to submit unit rate as per Attachment [Price Format].

Proposal Price shall be prepared to consider the Scope of Work & Supply
and the Definition and Measurment.
If item "A" is defined that "A" is included item "B" in the Definition &
Measurement, "A" should not be seperatly cacluated although "A" is

Unit rate in price format is fixed and shall neither be subject to price
escalation nor increase except for the item agreed by Contractor.
The Contract price shall be subject to adjustment in accordance with such a
final work quantity as calculated from IFC drawings(As-built drawings) using
unit rates as set forth in the Contract. Such unit rates shall be fixed and shall
neither be subject to the price escalation or increase for any reason.

All interface work shall be considered in bidder's unit price of related work in
BOQ. Regarding interface work, refer to Attachment [XXX] for detail
Cleaning work of drainage such as open ditch, pipe trench and perimeter
ditch during construction stage and pre-commissioning stage and final
cleaning work of the same, shall be considered in bidder's unit price of
related work in BOQ.
This contract is exclusively based on fixed unit rate & provisional work
volume and, not man-hour basis. The man-hour mentioned in the priced
BOQ is understood to be referred only for assessing the Bidder’s
mobilization capability and productivity.
When the contract documents fail to specify the applicable standards and
codes for any part or category of equipment or materials, the Owner and the
Contractor shall have the right to determine the applicable codes without
change to the Unit Price.
Regarding Material handling (unloading, storage, reloading, relocation,
transportation to jobsite, inspection and custody etc.), Refer to the
Attachment [XXX] for detail information. Material handling cost shall be
considered in the bidder's quotation.
Unpacking of delivered construction materials and equipments shall be
carried out within 3 days after Contractor’s request. And, all the costs for
unpacking and disposal and/or transportation to designated location shall be
included in the Unit Price.
Unit Price
2 If there are traces, dented place in existing facilities due to construction
in BOQ Sheet
activities, the cost for restoration work to be included.

Cost for temporary facilities for direct and indirect work such as scaffolding,
support, false work, barricading, portable toilets, water, etc. shall be included
in the Unit Price.

The safety cost such as safety helmet, safety shoes, safety belt, goggle,
other facilities for safety, etc to keep safety regulation to be included in the
Unit Price
Cost for idle time (or waiting time) to get work permit and/or gate pass for
manpower, material, vehicles, construction equipment and etc. shall be
included in the Unit Price.
Damages to facilities of the existing plant during the work shall be repaired
and reinstated at the Bidder’s own cost.
Debris, trash, waste materials, surplus materials, waste water, sanitary water
and etc. that need to be taken out of construction site shall be collected and
disposed as per the local regulation & Owner/Contractor standard and all
such costs shall be included in the Unit Price.
Electric power, diesel generator, water, air and other utilities shall be
supplied by Bidder and all the costs shall be included in the Unit Price.

Shelters, tables and chairs for workers’ rest and lunch break shall be
provided by the Bidder near Bidder’s temporary office area. And, all such
cost shall be included in the Unit Price. Eating at work areas shall not be
allowed.
It is the responsibility of Bidder to get the authorization from government
and/or local authorities and such cost shall be included in the Unit Price.

The price calculation details shall be submitted.


Unit Rate Unit rates for extra work items shall be derived from the unit rates of similar

mutual agreement prior to the start of the work.
Cost to meet Bidder can not claim these cost to Contractor in other words. Bidder shall be

quantity calculated from as-built drawings approved by the Contractor and by

The amount of the indirect cost portion is fixed and shall not be subject to
price escalation or increase except that, as a result of [Direct Cost
settlement], the amount of the direct cost portion is increased by more than
[ten percent (10%)] or decreased from the original direct cost stated in
[Direct Cost settlement]. Any adjustment to the Indirect Cost Portion as a
result of any such increase of more than [ten percent (10%)] of the Direct
Cost Portion or any decrease of the Direct Cost Portion shall be determined
solely by the Contractor after considering various matters, including the
Bidder's site and general cost items, of which substantial increase or
Indirect Cost
8 decrease may be expected. In such event, the amount of the direct cost

Adjustment for the fixed price portion = (x – y) X [IC / (IC + DC)]

x = amount of increase or decrease in the direct cost

Cost Adjustment of The final cost adjustment of materials supplied by Bidder shall be based on

Contractor Supply Contractor would supply material for Bidder if Bidder would not be able to

If Contractor request the information regarding the Tax and Insurance of
Bidder manpower, Bidder should submit the related all material to Contractor
within 2 week.

All insurance related with construction work shall be considered in Bidder's


proposal refer to Attachment [XXX] for detail information.

All of [Discpline] works is guaranteed for [XX] years according to Owner

Required Manhour Required manhours (direct labor manhour) shall be shown in Attachment
13 [Price Format] as one of Bid Requirements and this figure requires to be
same of technical proposal.
The order of priority in interpreting the Subcontract Agreement to resolve
any conflict, inconsistency or ambiguity and the application of such
subcontract documents shall be in the order as listed in Article 3.1

Agreement When the Subcontract is signed, the contents of Subcontract attached in
already issued ITB should not be changed.

No deviation is allowed in any provisions in Subcontract Agreement and
General Terms & Conditions which is proposed as a draft in ITB.
The site temporary facility shall be equipped with all necessary workers
requirements.
For less than 20 workers one (1) portable toilet should be provided, for
21~199 workers one (1) portable toilet seat and one (1) urinal shall be
provided for increase of every 40 workers and more than 200 workers one
(1) portable toilet seat and one (1) urinal shall be provided for increase of
every 50 workers. Bidder to regularly sanitize/clean all portable toilet
provided by Bidder.
Site Temporary Temporary facilities such as site offices, shelters, generators, fences, toilets

Facility with septic tank, water tanks and etc. required for construction shall be
removed upon completion of construction and the area should be reinstated
same to its original condition.

Any removal of Bidder’s temporary facility(s), construction material(s), and


construction equipment(s) out of job site shall be noticed to Contractor by
Bidder and approved by Contractor with written document.
All access roads and hard stands for all kinds of cranes shall be provided by
Bidder at his own cost.
Utility Bidder shall provide all construction utilities required for all construction and
pre-commissioning related uses, including preservation and drying. These
16 utilities are such as instrument air, utility air, nitrogen, portable water, utility
water,demineralized water, temporary electrical power and etc.

Organization chart Bidder represents and warrants that it has sufficient competent, experienced
and CVs of key and fully qualified personnel to execute the Work in a safe, efficient,
personnel environmentally sound, and professional manner and within the time
required by this bid documents.
17 Bidder shall submit an organization chart and CVs of key personnel to
Contractor, and must ger approval from Contractor. Once approved, Bidder
can neither change nor demobilize any personnel without Contractor's
written approval.
Manpower & Equip. Bidder is requested to provide "Manpower Mobilization Schedule" &
18 Mobilization "Equipment Mobilization Schedule" according to the BOQ of each discipline.
Schedule
Bidder shall consider all cost & work schedule impact due to the obstruction

Bidder shall consider cost impact & work schedule due to the obstruction of
particular areas especially at the following :
1) Operation area : [The existing facilities] shall be in normal operation
during the whole period of construction works, and the Bidder shall not
interrupt any activities of [The existing facilities] operation in any case
2) Other certain areas or any particular areas will be on hold during
construction caused by the Owner’s activities. The Bidder shall consider this
work interface may occur during construction period.

If Bidder falls behind the approved Work Schedule, Contractor shall take
such steps as may be necessary to regain the Work Schedule. The
Contractor representative may require Bidder to increase the number of
shifts, or overtime operative days of work per week, manpower loading or
equipment loading, or all of the foregoing and to submit for approval such
schedule as may be deemed necessary to demonstrate the manner in which
Behind Schedule the Work Schedule will be regained, all without additional cost to Contractor.

Control
If Bidder is behind the approved Work Schedule, Contractor may also at its
option hire additional labour and equipment to augment Bidder's construction
force, for which the costs will be back charged to Bidder. Bidder shall accept
and use additional labour force and equipment in the most expedient
manner, maximizing its use in an effort to comply with the Work Schedule
and complete the Work as quickly and efficiently as possible.

Drawing Bidder shall understand that all drawings attached in ITB documents are
information only. There is possibility to be changed during detail design

development and bidder shall accept that changes without claim to
Contractor.
Material Vendor All of materials in the scope of Bidder’s supply shall be supplied by vendor

approved by Owner refer to Attachment [Approved Supplier List].
Contractor shall provide [one(1)] safety officer per [50] workers for the
purpose of site safety control basically. But at night time, [one(1)] safety
23 HSE officer per [30] workers and If the work is critical [one(1)] safety officer per
[15] workers for the purpose of site safety control.
Security Provide proper security at each Work site and Bidder's material yard
24 acceptable to Contractor.
QA/QC Bidder shall consider all quality assurance and control requirements in
25 bidder's proposal according to the Attachment [Quality Requirments].
Bidder fully assist to get “ Government Work Permit” during whole
26 Work Permit construction stage.
The method statement shall be submitted for the approval of Contractor at
27 Method Statement least 3 weeks before the start of work.

Bidder shall organize separated full-time teams focusing on punch clear

Pre-commissioning activities shall be in Bidder’s scope as stipulated in
“Scope of Direct Work & Supply” of ITB package.
- All activities shown Contractor's proposed plan shall be done by Bidder as

pump car during construction period for risk management.

The term of validity of Advance Payment Bond and Perfomance Bond shall
be the end of Subcontract period.
The term of validity of Advance Payment Bond and Perfomance Bond can
be extended by Contractor, if necessary.
Bidder shall provide water truck for site dust control at working time during
the construction period.

10 housekeepers and 1 ton truck for the purpose of cleaning at site under
Constractor's safety part control shall be considered in bidder's unit price of
related work in BOQ. Contractor may request to increase the number of
either housekeeper or truck upon the performance of housekeeping, which
shall be at the Bidder’s cost.
Due to the project situation various equipments and materials are ready,
before starting the construction. Refer to Protection and Preservation
Procedure for proper arrangement.

document package.)
Superintendents and Supervisors who can communicate in English should
be provided on working area.
The minimum requirement for Superintendents and Supervisors is as
following as:
- [one (1)] Superintendent per [four (4)] Supervisors
- [one (1)] Supervisor per [four (4)] Foremans
- [one (1)] Foremans per [four (4) Working Crew
Such cost shall be included in the Unit Price.
