COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT is made and entered into by and between:

LUCIO V. CABURNAY, of legal age, Filipino, and a resident

of Zone 5, Barangay 10, Malaybalay City, Bukidnon, hereinafter
referred to as the FIRST PARTY.
- And -

SANTA R. CABURNAY, of legal age, Filipino, married and a

resident of Zone 5, Barangay 10, Malaybalay City, Bukidnon,
hereinafter referred to as the SECOND PARTY;

WITNESETH:
WHEREAS, the parties are willing to enter into an amicable
settlement;

NOW, THEREFORE, the PARTIES, in order to buy peace,

have mutually agreed to amicably settle under the following terms
and conditions, to wit:

1. That the FIRST PARTY is the respondent in a criminal

complaint for Violation of R.A. 9262 now pending before the Office
of the City Prosecutor of the City of Malaybalay, under NPS Docket
No. X-09-INQ-18K-187 while the SECOND PARTY is the private
complainant therein;
(Nga ang UNANG PARTY mao ang gikasuhan ug kasong
criminal sa paglapas sa R.A. 9262 nga naa karon sa Office of
the City Prosecutor of the City of Malaybalay, nga nay numero
NPS Docket No. X-09-INQ-18K-187, ug ang IKADUHANG
PARTY mao ang nagsumbong;)

2. That the FIRST PARTY undertakes that he will no longer

drink intoxicating liquor which is the main reason of his abusive
conduct towards the FIRST PARTY and his children;
(Nga ang UNANG PARTY nag saad nga dili na siya muinom sa
ilimnong makahubog nga mao ang pinakarason ngano siya
gapang dapat ngadto sa IKADUHANG PARTY ug sa ilang mga
anak;)

3. That the FIRST PARTY undertakes that he will no longer

intimidate, threaten, or otherwise coerce the SECOND PARTY and
their children;
(Nga ang UNANG PARTY nag saad nga dili na siya mang
hulga sa IKADUHANG PARTY ug sa ilang mga anak;)
 4. That the FIRST PARTY undertakes that he will no longer
visit Maquilan residence at Purok 2, Landing, Casisang, Malaybalay
City, Bukidnon;
(Nga ang UNANG PARTY nag saad nga dili na siya muadto ug
mubisita sa balay ni Maquilan nga naa sa Purok 2, Landing,
Casisang, Malaybalay City, Bukidnon;)

5. That the FIRST PARTY undertakes to go Osmena, Tagbina,

Surigao del Sur with his sister Evangeline Caburnay Ogdoc in order
for the FIRST PARTY to deter from abusing his family;
(Nga ang UNANG PARTY nag saad nga muoban siya sa iyang
igsoon nga si Evangeline Caburnay Ogdoc sa Osmena,
Tagbina, Surigao del Sur para mahunong ang iyang pag
pangabuso sa iyang pamilya;)

6. That the SECOND PARTY undertakes that she will desist

from testifying as the private complainant in the above-cited case
and cause the dismissal of the same so that the accused will be
liberated from prison;
(Nga ang IKADUHANG PARTY nag saad nga dili na siya mag
testimonya sa kaso nga kriminal nga iyang gipasaka ug ipa
dismiss niya ang kaso aron makagawas na ang IKADUHANG
PARTY;)

7. That should the FIRST PARTY fail to comply with any or all
of the aforementioned undertakings, the SECOND PARTY will
pursue the criminal charges and she will make sure that the FIRST
PARTY will be imprisoned.
(Nga kung ang UNANG PARTY mapakyas o dili mutuman sa
iyang mga saad, magpasaka usab ug kaso nga kriminal batok
sa UNANG PARTY ug siya ipa priso na gayud sa IKADUHANG
PARTY.)
