COMPLAINT -AFFIDAVIT

I, KANEKI KEN, 32 years of age, married, and a resident of Upper

LukeWright, Dumaguete City, deposes and says THAT:
1. I am the Father of Sunny Queen, 12 years old, enrolled as a Grade Five
Pupil at Silliman University. A machine copy of the birth certificate of
Sunny Queen is hereunto attached and made as an integral part hereof
as Annex “A”;

2. Last January 8, 2019, on or about 7 a.m., my daughter, SUNNY

QUEEN, after taking her breakfast and finishing her morning routine,
was preparing herself to go to school and leave the house.

3. Because of relatively short distance between our house and her school,
my daughter, SUNNY QUEEN, was used in walking unaccompanied
on her way to school.

4. Unbeknown to me that I will be seeing her for the last time. On or about
9 a.m. of January 8, 2019, I received a call from the President of
Silliman University, that my daughter was sent at Silliman Medical
Centre due to an accident and was in a critical condition. She was
pronounced dead on arrival, due to knife stab on her chest. The medico-
legal autopsy report, the NSO death certificate and a certification from
the City Civil Registrar of SUNNY QUEEN is hereunto attached and
made an integral part of the complaint as Annex “C”, “D”, and “E”,
respectively;

5. While at the hospital, I inquired the person who allegedly witnessed the
incident, MARK JOSEPH TOTING and DYBIE KUMINGKIT, to tell
me the identity of the person who killed my daughter. The sworn
statement of MARK TOTING AND DYBIE KUMINGKIT is hereunto
attached and made an integral part of this complaint as Annex “F” and
“G” respectively;

6. From the statements of MARK JOSEPH TOTING and DYBIE

KUMINGKIT, they were able to identify RAINER KING, as the one
who killed my daughter. RAINER KING has been reputed by his

 neighbors and relatives as a drug addict, delinquent and has a number
of criminal records in the past.

7. I immediately reported the stabbing incident on or about 5 p.m. of

January 8, 2019 at the Dumaguete Police Station. The original copy of
the excerpt of the police blotter duly issued by Senior Police Inspector
Lupin III of Dumaguete Police Station is hereunto attached and made
as an integral part hereof as Annex “H” of the complaint;

8. I am therefore executing this affidavit freely and voluntarily in support

of my intent to file a case for MURDER and/or the appropriate criminal
case against RAINER KING, who is 30 years of age and a resident
Cervantes Street, Dumaguete City.

IN WITNESS WHEREOF, I have hereunto set my hand this January 15,

2019 in Dumaguete City, Philippines.
