JUDICIAL AFFIDAVIT OF MALOU ANG Y MABINI


I, Malou Ang y Mabini, 18 years old, single, and living at #17 Masungit St.,
Quezon City,witness for the prosecution in this case, states under oath that:

PRELIMINARY STATEMENT
The person examining me is Atty. Honeygirl Pulot-Pukyutan with address at
10 General Avenue, GSISVillage, Quezon City. The examination is being
held at the same address. I am answering hisquestions voluntarily, to the best
of my knowledge and fully conscious that I do so under oathand may face
criminal liability for false testimony and perjury.

PURPOSE
This affidavit/testimony of witness Malou Ang y Mabini is being offered to
prove the existence of sufficient provocation on the part of the accused.
Q: Would you state your name?
A: I am Malou Ang y Mabini.
Q: Miss Mabini, when were you born?
A: I was born on July 14, 2000.
Q: Where do you currently reside?
A: I live at #17 Masungit St., Quezon City.
Q: Do you know Lulu Mabini?
A: Yes.
Q: How did you know her?
A: She is my sister.
Q: How old is your sister?
A: I think she’s 36 years old.
Q: What is her occupation?
A: She’s a sales lady at SM City Mall for 3 years now.
Q: Can you describe your sister’s relationship with your family members?
A: She is a bit moody at times. She’s also hard headed and usually does
things on her own. She also shouts at my aunt often when she gets drunk.
Q: Can you describe her usual mood?
A: She usually shouts at us when she gets angry. She also likes to destroy
things when she is angry or when she gets drunk.
Q: What are these things that were destroyed by your sister at home when
she was mad or drunk?
A: She usually breaks the dishes and whatever she sees like appliances.
Q: When was the last time your sister got drunk?
A: Last June 10, 2016 after she got off from work.
Q: What time did she arrive home on June 10, 2016?
A: Around 7 pm.
Q: Can you describe your sister the moment she arrived home from work?
A: She looks wasted and drunk. She cannot walk properly. She also brought
home a bottle of wine. She was shouting on top of her lungs “Mga hayop
kayo pare-pareho kayong sipsip. Mga ahas kayong lahat. Pwe!”
Q: Did your sister tell you about any of her problems lately?
A: She just said 2 days ago that she was aiming for promotion and she has a
rival at work whom she dislikes.
Q: Do you remember how the bottle of wine she was holding looks like?
A: It was a Fundador bottle. I think only ¼ of the bottle was filled up.
Q: Where were you when your sister arrived?
A: I was at the living room with Chica, my cousin and my aunt Sora.
Q: Are you living with your cousin and aunt?
A: No just my aunt because we take good care of her. She has down
syndrome.
Q: Who usually takes care of your aunt?
A: My mom. She’s her sister-in-law.
Q: Where were your parents on June 10, 2016 at aroud 7 pm?
A: They went out of town with my dad to celebrate their anniversary.
Q: How old is your cousin Chica?
A: She’s 25.
Q: How about your aunt Sora?
A: About 30, I guess.
Q: Can you give me your approximate distance to your sister at that time?
A: Around 6 meters away.
Q: After her arrival, where did your sister go?
A: She headed towards the living room where we were watching television.
Q: What happened after that?
A: My aunt suddenly grabbed the Fundador bottle. I think she’s trying to
play with it. My sister said, “Bitawan mo yan baliw ka! Wala kang kwenta!”
My sister keep on shouting and slapping my aunt. I was telling her to stop
but she didn’t want to. I was crying since I was so afraid. The bottle was
broken. Chica went to stop my sister saying “Tama na yan! Wag mo na
kasing patulan. Hindi ka lang mahiya sa sarili mo!” “Wag kang makialam
dito kundi sasaksakin kita,” my sister furiously replied. My sister continued
to slap my aunt and my cousin keep on pushing my sister away. My sister
then stabbed my cousin with the broken bottle.
Q: How often does this incident of your sister hurting your aunt happen?
A: It happens most of the time when she’s drunk.
Q: How many time have you seen your sister do this to Sora?
A: Around 3 times already. It’s my 4th time to see it happening this time.
Q: What do you usually do if you see your sister hurting your aunt?
A: I just ask Aunt Sora to go inside the room.
Q: Are parents aware of this?
A: No. My sister keeps on threatening me not to tell my parents. I just kept
quiet for a while.
Q: Can you describe the bottle that was used by your sister to stab your
cousin after it was broken?
A: She used the head of the bottle. It has really sharp edges.
Q: Where was your cousin stabbed?
A: On her chest near the heart.
Q: How many times did your sister stab your cousin?
A: I’m not quite sure since I went out of the house immediately to seek for
our neighbors help. Rico Gutierrez and Ronal Orante, both barangay tanods
helped me. They rushed my cousin to the hospital but was dead on arrival.
