LEGAL RIGHTS OF A SOLDIER’S WIFE

1. YOU MUST KNOW

2. Name of husband as recorded in his service documents.


3. His personal Number.
4. The Regiment of Corps he belongs to.
5. His present unit.
6. Date of your marriage.
7. Names/Dates of birth of your children.
8. Address of his Regimental or Corps records office.
9. Address of nearest Sub Area to your village/town.
10. Joint Account number and full address of your Bankers.
11. Copy of pension payment order (PPO).

a. ENSURE YOUR HUSBAND HAS DONE THE FOLLOWING

12. Whether your marriage has been registered, published and entered in his
service document(Unit Part II Order) and other Govt correspondence.
13. Whether you have been nominated as the Next-of-Kin.
14. Whether Unit Part II orders have been published regarding birth of
15. your children.
16. A joint photograph with y our husband.
17. Whether he has executed his will.
18. Whether you have a joint bank account with your husband at your
19. permanent place of residence.
20. Whether you have been nominated for Army Group Insurance (AGI) and
AFPP/DSOP Fund.

a. YOUR LEGAL RIHTS

21. To reside with your husband in peace area.


22. To reside in separated family Govt accommodation when your husband is
posted in field.
23. Not to permit your husband to contract plural marriage during your
24. lifetime.
25. Right of maintenance allowance to yourself(22%) and to your Children (5 ½%
for each child).
26. Right to get your property (Stri Dhan) after your divorce.
27. Right of asks for divorce if your husband indulged in illicity sexual
28. relation with another woman.
29. Right to stay with your minor children after being divorced.
30. Right to travel on travel on Govt expense while accompanying physically
handicapped husband.

a. RIGHT TO MAINTENANCE

31. If your husband does not keep you and your children with him at his duty
Station, you are entitled by law to claim maintenance for yourself and your
children in accordance with section 125 of the criminal procedure code 1973.
Under this Authority you can approach the court of local Judicial Magistrate
and file a petition to obtain maintenance allowance. This prices is however,
time consuming and expensive. The easy way out therefore, is to claim the
maintenance in accordance with sections 90(i) and 91 (i) of the Army Act
1950. Under authority of these sections of the Army act, you can address a
simple letter to any of the authorities from the commanding officer of your
husband to COAS at Army Headquarters,

32. South Block, New Delhi and ask for the maintenance. Thus way you would
get the maintenance allowance with speed. Such an application should
include the following details:-

33. Personal number, Name and Unit of husband.


34. Date and place of your marriage.
35. By which religious rites your marriage was solemnised.
36. Joint photograph with your husband.
37. A copy of Unit Part II order publishing your marriage.
38. Names of children with dates of their birth.
39. Since when and why your husband is not maintaining you.
40. Whether you are employed anywhere.
41. Any other source of your income.

a. RIGHTS AFTER DEATH OF HUSBAND

42. Right to property as per his will.


43. Right to AGI money as per the nomination (officers Rs.8,00,000/- and
JCOs/OR Rs 3,75,000/-).
44. Right to DSOP/AFPP Funds as per nomination.
45. Right to bank balance as per nomination.
46. Right to future property as legal heir.
47. Right to pension and gratuity.
48. Right to insurance money.
49. Right to children education allowance.
50. Right to financial assistance is case of death in air crash.
51. Right to balance of pay and allowances with interest from
a. PAO/CDA(O).
52. Right from Regiment/Corps.
53. Rs.15000/- from Army Officers Benevolent Fund (AOBF) for windows of
officers only.
54. Rs.300/- per month as assistance for accommodation from AG’s Branch.
55. Right to benefits of LIC/PLI policies as per nomination.
56. Right to distress gant if your financial condition becomes precarious.
57. Right to financial assistance for daughter’s marriage if in financial
58. hardship.
59. Right to financial assistance from AWWA.
60. Right to get rented house vacated for your own occupation.
61. Right to CSD Canteen facilities.
62. Right to gas/petrol agency etc (for War Widows).
63. Right to stay in Government accommodation till six months after death of
husband.
64. Rights by succession.
