1 (2) For the purposes of ORS 657.155 (1), an individual who performs full-
2 time services in any week for an employing unit is not unemployed even
3 though remuneration is neither paid nor payable to the individual for the
4 services performed; however, nothing in this subsection shall prevent an in-
5 dividual from meeting the definition of “unemployed” as used in this section
6 solely by reason of the individual’s performance of volunteer services with-
7 out remuneration for a charitable institution or a governmental entity.
8 (3) The Director of the Employment Department shall prescribe rules as
9 the director deems necessary with respect to the various types of unemploy-
10 ment.
11 (4)(a) Notwithstanding subsections (1) and (2) of this section, rules
12 prescribed by the director under subsection (3) of this section may
13 provide that an individual may not be excluded from being deemed
14 unemployed solely because of service:
15 (A) Performed for an employing unit that is legally compelling the
16 individual to perform the service; and
17 (B) For which the individual has not received payment on the
18 individual’s regular payday.
19 (b) An individual who is deemed unemployed pursuant to this sub-
20 section shall continue to be so deemed until the earlier of the date on
21 which:
22 (A) The individual begins to receive payment for the service on the
23 individual’s regular payday; or
24 (B) The individual permanently ceases work for the employing unit.
25 SECTION 2. The amendments to ORS 657.100 by section 1 of this
26 2019 Act apply to claims for benefits by individuals described in ORS
27 657.100 (4) filed in any week, as defined in ORS 657.010, that began or
28 begins on or after December 22, 2018.
29 SECTION 3. (1) An individual is entitled to benefits under this sec-
30 tion if, at the time the individual files a claim for the benefits, the
31 individual:

1 (a) Is on active duty in the United States Coast Guard and stationed
2 in this state;
3 (b) Is legally compelled to perform service in the United States
4 Coast Guard for the individual’s regular hours of work;
5 (c) Is not receiving payment for the service because of the lapse of
6 federal appropriations; and
7 (d) Would otherwise be eligible for unemployment compensation for
8 ex-servicemembers as provided under 5 U.S.C. chapter 85.
9 (2) Except for the eligibility requirements under subsection (1) of
10 this section, benefits under this section shall be subject to the same
11 requirements and procedures as regular benefits as defined in ORS
12 657.158.
13 (3) If an individual who receives benefits under this section receives
14 back pay from the federal government with respect to the period for
15 which the individual received the benefits, the back pay shall be con-
16 sidered earnings for that period.
17 (4) An individual who is entitled to benefits under this section shall
18 continue to be so entitled until the earlier of the date on which:
19 (a) The individual begins to receive payment on the individual’s
20 regular payday for service performed in the United States Coast
21 Guard; or
22 (b) The individual permanently ceases active duty in the United
23 States Coast Guard.
24 (5) The Director of the Employment Department may prescribe
25 rules as the director deems necessary with respect to benefits under
26 this section.
27 (6) Notwithstanding ORS 657.815, benefits payable under this section
28 and under rules prescribed by the director pursuant to this section,
29 and the costs necessary for the Employment Department to administer
30 this section and any rules prescribed by the director pursuant to this
31 section, shall be paid using the moneys appropriated to the department
