AFFIDAVIT OF NBI INSPECTOR - JAMES BANDA

I, NBI Inspector - James Banda, of legal age, married, and


living at Number 08 Rose Street, Bria Homes, Digos City, after
having been duly sworn, hereby attests that:

PRELIMINARY STATEMENT

The person examining me is Atty. Pamela Carr Holt, RN with


Law Office address at 34 Rose Street, Digos City. The
examination is being held at the same address. I am answering
her questions fully conscious that I do so under oath and may
face criminal liability for false testimony and perjury.

PURPOSE

This affidavit/testimony of NBI Inspector James Banda is
being offered to prove that the fingerprint found on the gun
holster that was found on the scene of the crime, (The fatal
shooting of Doctor Ferdinand Edralin Marcos) matches the
fingerprints of Mr. Mar Roxas.

Explanation

Human fingerprints are detailed, nearly unique, difficult to


alter, and durable over the life of an individual, making them
suitable as long-term markers of human identity.

They may be employed by police or other authorities to


identify individuals who wish to conceal their identity, or to
identify people who are incapacitated or deceased and thus
unable to identify themselves, as in the aftermath of a natural
disaster. Fingerprint analysis, in use since the early 20th
century, has led to many crimes being solved.

Fingerprints collected at a crime scene, or on items of


evidence from a crime, have been used in forensic science to
identify suspects, victims and other persons who touched a
surface.

Fingerprint identification emerged as an important system


within police agencies in the late 19th century, as a more
reliable method for identifying persons having a prior record,
often under a false name, in a criminal record repository.

Fingerprinting has served all governments worldwide during


the past 100 years or so to provide identification of criminals.

Fingerprints are the fundamental tool in every police agency


for the identification of people with a criminal history. They
remain the most commonly gathered forensic evidence
worldwide, and in most jurisdictions fingerprint examination is
more common than all other forensic examination casework
combined.

Q1. Please state your name, age, and permanent address for
the record.

A1. My name Is James Banda. 45 years of age, I live in Number
17 Star Apple Street, Camella Homes, Digos City.

Q2. What is your occupation?

A2. I am a forensic finger print expert working at the National


Bureau of Investigation Office in Region Eleven.

Q3. Why are you executing this affidavit?

A3. I am here at the request of my Superior Officer to testify


on the results of the fingerprint analysis of the shooting incident
on December 27, 2017 at Tres de Mayo, Digos City where Dr.
Edralin Marcos was shot dead.

Q4. Why did your Superior Officer ask you to testify here?

A4. Because I was the one who conducted the fingerprints


analysis on the gun holster that was found at the scene of the
crime.

Q5. To cut the story short, what were your findings Sir?

A5. The prints found on the gun holster matches that of the
accused Mr. Mar Roxas.

Q6. How did you come to this conclusion?

A6. By using the Alternate Light Source (ALS) method.


These are laser or LED devices that emit a particular
wavelength, or spectrum, of light.
I used a device that has a filter to provide a variety of
spectra that can be photographed or further processed with
powders or dye stains.
Q7. What did you discover?

A7. The prints that were lifted from the gun holster matches
the right thumb and right pointer finger of Mr. Mar Roxas from
his police record.

Q8. How accurate is this test?

A8. I would say it is extremely accurate because no two persons
would have the same set of fingerprints, and if there is such a
case of this, the odds would be one in 64 billion. This is because
fingerprints are formed when a human is still a fetus so they
are very unique in each individual.

Q9. How long have you been in this job?

A9. 10 years.

Q10. How many times have you been a witness in a trial


before?

A10. This would be the 30th time that I have testified to the
results of my findings.

Q11. How many times did you make a mistake?

A11. None so far since I would not dare make any testimony if
my findings prove to be inconclusive.

Q12. Where did you get your training for Forensics work?

A12. I studied Criminology in College at Cor Jesu University,


after graduation, when I joined the NBI, they trained me for
two years to do Fingerprint Analysis, I was sent to a Training
Seminar for three months in Langley, Virginia by the NBI to
learn from American Experts in the FBI and CIA.

Q13. Can you summarize your statement today sir?

A13. The fingerprints found on the gun holster at the crime


scene, matches those of the fingerprints of the accused Mr. Mar
Roxas.

Q14. Is there anything else that you would like to add sir?

A14. I brought with me the fingerprint analysis results, and the


picture of the holster to present to the court.
