SUMMARY
That on January 1, 2019 at 7 o’clock in the evening in Legazpi City
and within the Jurisdiction of this Honorable Court, the said accused,
Cardo Dalisay, with force and intent, committed the crime of Rape against
the complainant, Catherina Gray.

Version of the Prosecution
That on January 1, 2019 at 7 o’clock in the evening, the complainant
was supposed to buy dinner for herself and her grandfather when the
accused, carrying a rod- like object approached her and punched her in the
stomach, removed her jogging pants, and pulled down her underwear. The
complainant tried to feel her head and the part where the accused hit her
was bleeding, which caused her to have lost her consciousness.
Version of the Defense
That on the night of Jan 1, 2019, after working hard in the fields, Cardo
Dalisay went home, ate his supper, had drinks with his niece, then he went to sleep.
Issue to be resolved
Whether or not the accused committed the crime as charged.

It is understood that the testimony of the witness should be completed on the
scheduled date of hearing allotted to said witness under the One-day Examination of
Witness Rule. The Court however, has the discretion on whether or not to extend the
direct and/or cross examination of witnesses for good cause shown. Failure of the
party or his counsel to comply with the aforementioned schedule of hearings and
deadlines may be a ground for imposition of fines and other sanctions by the Court.
