Introduction
This set of cards is based upon the following assump ons:
A. Counsel is responsible for making sure that electronically stored informa on is preserved by:
Issuing preserva on le ers.
Following‐up every 60 to 90 days to confirm preserva on techniques are in place.
B. Most clients do not have the computer skills to effec vely preserve electronically stored
informa on without assistance. Paralegals with proper training and supervision can help bridge
the gap by backing up phones and laptops when the par es visit counsel’s office.

Then create a preserva on plan based upon that list.
