I believe there is probable cause to charge the defendant with these charges because:
On 01/23/19, Detective Z Jones was conducting an online investigation on peer to peer file sharing software for
offenders sharing child pornography. Investigative focus was directed to a device and IP address that appeared
to be sharing files of child pornography. Using a computer running investigative peer to peer software, the
computer directly connected to the suspect device and a download was successfully completed of suspect files.
The downloaded files were reviewed and the files that were downloaded from the suspect device depicted
prepubescent and pubescent children in sexually explicit situations.
A subpoena was subsequently served on the internet service provider for identifying information pertaining to
the subscriber of the suspect device and IP address. The internet service provider responded to the service of
the subpoena and identified the subscriber as a residence in Layton, Utah. On 03/13/19 , members of the FBI
Child Exploitation Task Force served a residential search warrant on the above address searching for evidence of
child pornography. During the search of the residence, evidence of child pornography, including files that
appeared to match the original downloads, were found on a desk top computer belonging to Carlos Manuel
Rodriguez (08/23/99). Carlos was interviewed and post Miranda, initially denied that he had downloaded any
files of child pornography. Carlos was confronted with the evidence found on his computer during the search and
admitted to downloading the files of child pornography on his device.
Based on Carlos's admittance and the evidence found on his computer, there is probable cause to believe Carlos
committed the crime of Sexual Exploitation of a Minor.
