RESOLUTION NO. 05
Series of 2018

“A RESOLUTION REQUESTING THE OFFICE OF DEPARTMENT OF BUDGET AND

MANAGEMENT (DBM) TO GRANT THE EXEMPTION OF COMPOSTELA VALLEY
PROVINCE BARANGAYS ON THE REQUIREMENT OF PROCUREMENT BY ELECTRONIC
MEANS AND THE PHILIPPINE GOVERNMENT ELECTRONIC PROCUREMENT SYSTEM
(PHILGEPS) TO THE BIDDING PROCESS.”

WHEREAS, Republic Act No. 9184 also known as an Act Providing for the
Modernization, Standardization and Regulation of the Procurement Activities of
the Government and for Other Purposes which shall apply to the Procurement of
Infrastructure Projects, Goods and Consulting Services, regardless of source of funds,
whether local of foreign, by all branches and instrumentalities of government, its
departments, offices and agencies, including government-owned and/or-controlled
corporations and local government units, subject to the provisions of Commonwealth Act
No. 138 was enacted on January 10, 2013;

WHEREAS, section 8.3.1 of the 2016 Revised Implementing Rules and

Regulations of RA 9184 provides that “All Procuring Entities are mandated to fully
use the PhilGEPS in accordance with the policies, rules, regulations, and
procedures adopted by the Government Procurement Policy Board and
embodied in this IRR. In this connection, all Procuring Entities shall register with
the PhilGEPS and shall undertake measures to ensure their access to an on-line
network to facilitate the open, speedy and efficient on-line transmission,
conveyance and use of electronic data messages or electronic documents.”;
 WHEREAS, the registration to the PhilGEPS requirement needs internet
connection;

WHEREAS, most of the Barangays in the Province of Compostela Valley are

located in remote and far areas and due to the geographic location of said
places, cellular network signals are lacking, which makes communication and
internet connection difficult;

WHEREAS, it is difficult for the personnel to travel down town due to the
lack of transportation services, furthermore not all of the personnel are
computer literate;

WHEREAS, during the 2nd meeting of the LNMB dated September 24, 2018,
the body had agreed to ask consideration from the office of the DBM to exempt
the barangays on the requirement of PhilGEPS to the bidding process;

NOW, THEREFORE, with the unanimous accord of the members of the

provincial Liga ng mga Barangay, be it:

RESOLVED, as it is hereby resolved, , in lieu of the mandate to use PhilGEPS,

it is prayed that other means of effective publication such as posting in two to
three different places easily accessible by the public, may be used to procure
infrastructure projects, goods and consulting services; for strict implementation of such
would be prejudicial to the best interest of the community in rendering public service;
