PETITION

Petitioner by the undersigned counsel, and unto this Honorable Court, respectfully
alleges that:

1. On January 10, 2019, petitioner presented to the Register of Deeds of Iligan for
registration a Deed of Sale of a certain parcel of land located in Brgy. Dalipuga
wherein Jason Dy was the vendor, and petitioner, the vendee;
2. Said Deed of Sale on said date was duly entered in the Entry Book of the said
Registry of Deeds as Entry No. 67890;
3. The Deed of Sale as thus presented, was accompanied by the owner’s duplicate
certificate of title, Transfer Certificate of Title No. 123456 of the Register of Deeds
of Iligan;
4. Pending registration of the above papers and documents, and while same were in
the possession and custody of the office of the said Register of Deeds, the building
in which was housed said office was burned to the ground, together with all its
records and papers;
5. Upon the re-establishment of the said Office of the Register of Deeds, petitioner
made inquiries of said office regarding the above Deed of Sale and accompanying
Transfer Certificate of Title No. 123456 but was informed that said papers were
missing and were not among those salvaged from the fire wreckage;
 6. In view of the above, the said Transfer Certificate of Title No. 123456 of the
Register of Deeds of Iligan must be deemed to have been lost or destroyed.

WHEREFORE, pursuant to law, and in view of the fact that said Transfer Certificate
of Title had been lost or destroyed, it is respectfully prayed that, after due proceedings,
an order be entered directing the Register of Deeds of Iligan to issue a new duplicate
Certificate of Title No. 123456, the same to be regarded as the original certificate for all
purposes of the law.

1. I am the petitioner in the above-entitled Petition;
2. The facts stated in the above Petition are true and correct to the best of my
knowledge and authentic records;
3. I have not commenced any action involving the same issue in court, tribunal or
quasi-judicial agency and, to the best of my knowledge, no such other action is
pending in them; and
4. If I should learn that the same or similar action has been filed or is pending after
its filing, I shall report that fact within five (5) days from notice to the court or
where the petition has been filed.
