AFFIDAVIT

I, AUDIE R. SABAOT, of legal age, married, Filipino, and a resident of

2015 Gril and Restobar, Sta. ana St., Corner Gil Fernando Avenue, Marikina
City, after having been sworn to in accordance with law, do hereby depose
and state:

That I am the defendant in the civil case pending before Regional Trial
Court of Cagayan de Oro, Branch 21, docketed as Civil Case No. CV-ORD-
2018-888.

The above-mentioned case was referred by the Honorable Court to the

Philippine Mediation Center-Cagayan de Oro for mediation conference on
April 26, 2019.

That, a week before the aforesaid date, I was advised by my doctor to

avoid long distance travel due to my hypertension. Hence, I issued an
authorization letter to Mr. Ramon C. Joson to appear in my behalf on the
scheduled mediation proceeding through an Authorization Letter dated April
23, 2019.

However, on the said date and hearing, through the objection of the
plaintiff, the mediation officer did not honor the aforesaid authorization letter
for lack of legal formalities, hence, no mediation proceeded as Mr. Joson was
not allowed to appear.

That I did not intend to defy or disrespect the lawful order of

Honorable Court. I did not intend to delay the proceedings of the case but
only for the aforesaid reason.

That I execute this affidavit to attest the truth and veracity of the
foregoing statements to support my objection to the manifestation of the
plaintiff in the above-mentioned case to declare me as in default in which
such manifestation is a mere sheer of technicalities as against the valid and
meritorious defenses I raised in my Answer; and for whatever legal purpose
that this may serve.
