READ:- 1. Report of the Sr. Inspector of police, Parksite Police Station,
Mumbai, O.W.No. /2019, Dt. 29/05/19

2. Paper in investigation of Parksite Police Station, Mumbai,

Spl.LAC. No. 66/19 u/s. 3,25 Arms Act r/w. 37 (1) (a) 135 M.P.Act.
WHEREAS, on 03/04/19 Shri.Santosh Vikram Rathod,Police Constable
No.0901066 , attached to Parksite Police Station, Mumbai, lodged a complaint
against accused person namely Shalil Usman Abdullah Kazim, age 42 Yrs. R/o.
Room No. 602, Samnan Park, Jivanbagh,Mumbra West Thane. According
Parksite Police Station, Mumbai, has registered Spl. LAC. No. 66/19 u/s. 3,25
Arms Act r/w. 37 (1) (a) 135 M.P.Act. and investigated.
WHEREAS, on 03/04/19 between 20:45 hrs. and 22:00 hrs.at Infront of
Nagori Tea House, Road No. 07, Vicroli west Mumbai,accused person namely
Shalil Usman Abdullah Kazim, age 42 Yrs. R/o. Room No. 602, Samnan Park,
Jivanbagh,Mumbra West Thane, was found in possession of One Foreign Made
Pistol alongwith six live cartridges without requisite licence under the Arms Act
1959, to acquire, to carry and or to posses the said firearm and ammunitions
for which he has been arrested in the above case. The said firearm and
ammunitions were seized in the presence of panchas.
AND WHEREAS, the articles seized are as under:-
Exhibit 1 One Foreign Made Pistle, Black colour,Iron metal, BRUNI MOD.
92 AUTO kal 8 mm – written on Barel Body,Aproximately 01 kg.
200 gm. Weighted, Having one Iron Magazine.
Exhibit 1 Six brass live cartridges having stamp marking Y.A.S.8 mm on
back side and green Plastick cover in front side, among six
cartridges two cartridges have indentation mark on percussion
cap and green plastic cover is bursted.
AND WHEREAS, the Asstt. Chemical Analyzer to the Govt. of Maharastra
(Ballistics Expert) Forensic Science Laboratories, Mumbai has inter- alia
analyzed, analysis done between dated 06/05/19 to 08/05/19 and has opined
and given report dated 24/05/19 the Exhibit 1 is a 8 MM caliber signal/ blank
pistol in working order residue of fired gun were detected in barrel washing of 8
MM caliber signal/ blank pistol Exhibit 1, showing that caliber signal/ blank pistol
Exhibit 1 was used for firing prior to its receipt in the Laboratorory.

Randomly selecter one 8 MM signal/ blank pistol cartridge from Exhibit

2B was successfully test fired through the 8 MM signal/ blank pistol Exhibit 1.

The empty Magazine in Exhibit 2A easily seats in the butt stock cavity of
signal/ blank pistol Exhibit 1 and it has capacity to accommodate about signal/
blank pistol cartridges.

The empties in Exhibit 2C and 2D are fired 8 MM. signal/ blank pistol
cartridge cases having indentation on their caps. The characteristic features of
firing pin indentation on the empties in Exhibit 2C and 2D (obsereved under
camparison microscope) tally among themselves and tally with the cartridge test
fired from 8 MM caliber signal/ blank pistol Exhibit 1, showing that empties in
Exhibit 2C and 2D have been fired from 8 MM caliber signal/ blank pistol Exhibit 1
.
AND WHEREAS, on perusal of the record from this office the paper on the
record of Parksite Police Station, Spl.No. 66/19 u/s. 3,25 Arms Act r/w. 37 (1) (a)
135 M.P.Act. I am satisfied that, this is a ' Prima Facie' Case for the contravention
of the provision of section 3 punishable u/s. 25 (1- B) (a ) of the Arms Act
1959,and there exists enough material on record to accord sanction in institute
procecution.

NOW THEREFORE, I ------------- Dy. Commissioner of police ( Head Quarter-

1 ) Brihan Mumbai, being the District Magistrate under clause (d) of sub Section 2
of Arms Act 1959 and in exercise of the power conferred upon me U/sec. 39 of
Arms Act 1959 wide Govt. of maharastra Gazette G.N.D.H. No. 1168/41151-X,
Dated 12/07/1971 (M.G.Pt. IV- A.P.-505), hereby accord sanction for prosecution
of the said accused person namely, Shalil Usman Abdullah Kazim, age 42 Yrs. R/o.
Room No. 602, Samnan Park, Jivanbagh,Mumbra West Thane, for the
contravention of the provision of section 3 punishable u/s. 25 (1- B) (a ) of the
Arms Act 1959, for taking cobnizance of Parksite Police Station, Mumbai,Spl.No.
66/19 u/s. 3,25 Arms Act r/w. 37 (1) (a) 135 M.P.Act. by the competent court.
