Collaborative Agreement

Between the
Christina School District Board of Education
and the
Christina Education Association

STUBBS ELEMENTARY - MEMO OF UNDERSTANDING


July 1, 2011 – June 30, 2013

This MOU is a DRAFT document and will continue to evolve as the plan develops.
During the term of this agreement the parties agree to:

13:1 EMPLOYEE WORK YEAR

The in-school work year and/or length of day for employees on a ten-month basis
shall be extended based on the instructional model selected. Currently, Stubbs
is designing an extended day schedule which will involve staggered start times
for staff and provide students with a minimum increase in learning time of
15%. This option will minimize the number of teachers who will be
required to work a longer school day. Compensation for a longer work day
will be based on each teacher’s per diem rate (as found on the 2010-
2011Teacher’s Salary Schedule). In addition Stubbs is designing an
extended school year schedule for identified students. Interested teachers
will apply for these positions and will be compensated at the summer school rate.

14:1.6 VOLUNTARY TRANSFER PERIOD

The transfer period will be comprised of two parts: a fifteen day application
window followed by a 30 day placement period.

Positions which open after this voluntary transfer time period, will be available for
interested district employees to apply and interview for in a late Spring job fair.

14:2.1 ADVERTISEMENT/INTERVIEWS

14:2.4 Selections for all positions shall be determined based on interviews conducted
by the building leader and Members of the Partnership Zone Technical
Assistance Committee. Teacher representatives may also be invited to
participate on the interview team for new candidates. Current staff and new
candidates will be required to participate in the interview process. Candidates
will be evaluated based on the following criteria: certification, highly qualified
status, system-wide balance, and other relevant information.

Permanent contract employees who are not selected for a position in a


Partnership Zone school will participate in the voluntary transfer process.
Staff will be required to sign a letter of commitment by March 31, 2011 agreeing
to fully participate in the school’s transformation for a minimum of two academic
years.

14:4 VOLUNTARY TRANSFER

Once a candidate is selected and accepts a position at Stubbs, employees will


be required to spend at least two transfer periods at Stubbs Elementary before
being eligible to transfer. This initial transfer period must be with continuous
service.

Current staff will be required to sign a letter of commitment by March 31, 2011
agreeing to fully participate in the school’s transformation for a minimum of two
academic years. New staff will be required to sign a letter of commitment within
five working days of accepting the position at Stubbs.

14:4.1 Employees who desire a transfer to or from Stubbs Elementary must file a
transfer form with the Human Resources Office. Such written form must be
submitted within the fifteen day application window (see 14:1.6).

Selection of candidates for Stubbs Elementary during the Voluntary Transfer


process will be based on interviews conducted by the building leader and
Members of the Partnership Zone Technical Assistance Committee. Candidates
will be evaluated based on the following criteria: certification, highly qualified
status, system-wide balance, and other relevant information. Selection of
candidates for positions at non Partnership Zone Schools during the Voluntary
Transfer process will follow the current Negotiated Agreement (14:2.4).

Candidates will receive the offer of a transfer via their District email address.
Applicants will have 24 hours, not including weekends and holidays, to accept or
decline the offered placement.

Current staff will be required to sign a letter of commitment by March 31, 2011
agreeing to fully participate in the school’s transformation for a minimum of two
academic years. New staff will be required to sign a letter of commitment within
5 working days of accepting the position at Stubbs.

14:4.5 Permanent vacancies not filled through the voluntary transfer process shall be
filled utilizing an interview process. Current Christina District employees and
Non Christina candidates will be eligible to apply for open positions.

15.0 EMPLOYEE APPRAISAL

15:4.1 When an employee is notified that an improvement plan will be developed,


he/she will be told that he/she may want to have an Association representative
present. Any teacher with a continuing license who is participating in an
Improvement Plan will be expected to successfully complete the Plan prior to
May 1 of the current school year.
16:2 LAYOFF

16:2.6 Open staff positions at Stubbs Elementary will not be included on the recall list
for two academic years. Positions will be filled following the process described in
14:2.4.

18.1 SICK LEAVE

18:1.1 Teachers and other school employees shall earn sick leave with full pay based
on Title 14, Chapter 13, Sub-section 1318.

19.0 TIME REQUIREMENTS

19:4.1 In addition to the in-school day, employees agree to direct their major effort
toward activities which promote the educational process and which are
necessary to clarify school business or provide professional growth.

(a) Those meetings necessary to fulfill requirements for Middle States or

State Department of Education school evaluations, which are in addition


to those held during the school day.

(b) Teachers will be required to participate in 60 meetings per year. These


meetings shall not exceed sixty (60) minutes except in cases of
emergency. This would include faculty meetings, professional learning
communities (held outside of the required planning period PLC),
professional development, and coaching sessions. Essential meetings
necessary beyond those listed to resolve critical school problems would
be incorporated into this meeting requirement.

Compensation for the additional responsibilities will be in the form of a


$4,000 stipend for each teacher. The stipend will be incremental to the
regular Teacher Salary Schedule compensation level.

19:4.3 The Association and the Board agree that as a professional each employee is
expected to devote to his/her assignment the time necessary within and
beyond the normal in-school day to meet his/her professional responsibility. It is
understood that employees will be expected to attend two (2) open house events
per school year. Staff will be required to participate in one evening activity per
month and to conduct parent conferences each semester. Compensation for the
additional responsibilities is included in the $4,000 stipend listed in 19:4.1 b.

Teachers will receive release time at student dismissal on a rotating basis. The
schedule will be developed and communicated by school administrators by
October 1st of each school year.

19:5.5 Staff will be required to participate in a Professional Learning Community during


one planning period per week.

22.0 PROFESSIONAL DEVELOPMENT


22.3 The Board and Association recognize the obligation of employees to participate
in professional development programs for the improvement of curriculum and
performance. Teachers will be required to participate in additional professional
development beyond the District PD schedule. The amount of time required will
be determined by the instructional model selected. Compensation will be per the
Negotiated Agreement.

25.0 BENEFITS

25:11 Employees who work in the City of Wilmington, and who are required to pay the
city of Wilmington wage tax, shall be compensated for the total cost of the wage
tax.

25:12 Employees will be eligible for a bonus based on school wide success in
achieving the required growth for AYP.

32.0 MISCELLANEOUS

32:8 The Board and Association recognize the importance of continual improvement
for both staff and students. The use of a Walk Through process will be utilized to
maintain focus on the school’s goals and to provide continued information on the
effectiveness of professional development, fidelity of curriculum implementation,
and student engagement.

A consistent walkthrough template will be developed and utilized.

32:9 As part of the Transformation Model, a Partnership Zone Technical Assistance


Committee will be created. Members of this committee and other instructional
support individuals will visit the school and provide support and feedback to
the administrators.

When feasible, building leaders will provide advance notice to teachers of


walkthroughs being conducted by non school personnel.

Both parties concur that the MOU may be revisited during the final planning and
implementation stages when both parties are in agreement.
