PRODUCTION AND OPERATING DEPARTMENT:

The production of fish aquarium, landscape, garden decoration and waterfall will
be done by us, we will be the engineers and by hiring the labors on daily wages.
The equipment required for the making of all the above mentioned products will
be bought from the suppliers. After the order is given by the customer the
construction of fish aquarium and landscape decoration will be done by us but
the other work that includes fixation of electric motor to circulate water in the
waterfall and plumber for fitting the pipe, for this purpose an electrician and
plumber will be hired on daily wage basis. Our suppliers list is given as follows:

4. OSACA, Rawalpindi,

The suppliers will also be from Peshawar and Rawalpindi for the purchase of
some Chinese pumps. Fish suppliers and submersible pump suppliers are
mentioned above.

MANAGEMENT AND PERSONNEL REQUIREMENT:


All Partners of the Partnership shall share in management of the Ordinary
Business Activities of the Partnership. The management consists of all the
partners of the firm. The planning, controlling and organization of all the activities
will be done by us. All the partners will be responsible for all the functions of the
firm. The hiring of labors will be done on daily wages basis. We will be the
engineers and decorators of all the products, some of the work which involves
electricity and plumbing will be done by the labor we will hire on daily wage basis.
After sale service will also be provided to the customers by us.
FOLLOWING WORKS ARE AGREED TO BE DONE:

1: Designing of the waterfall.


2: Purchase of submersible pumps from the suppliers, Order for the purchase of
stones.
3: Hiring of labor to construct the waterfall structure. Hiring of electrician for the
fixation of electric motor to circulate the water in the waterfall. The hiring of
plumber for pipe fitting.
4: Payment of wages and salaries to the labor.
5: Provision of post paid services.
6: Finishing of the waterfall.

INTELLECTUAL PROPERTY RIGHTS:


The name of our business is Tropical Waterfall, in the north Punjab area. The
office would be located on Mid Way Satellite Town Rawalpindi. The office, in
which we will be conducting our business particulars, will be on rent basis. The
business is started by 6 partners. Each partner is contributing his capital in equal
ratio as this partnership is on the partners own will. We will be registering the firm
under the partnership ordinance 1932. The procedure for the registration of
partnership is as follows:
PARTNERSHIP DEED
The procedure of registration is simple. According to the partnership law, the
mutual rights and obligations of all partners must be documented in the shape of
a “partnership deed”. This will be signed by all the partners and each partner will
have the copies of that deed. At the time of registration, a copy of the deed will
be submitted with an application to the Registrar of Firms.
APPLICATION for PARTNERSHIP:
An application in the following form given in the annexure (or Form No. 1
Partnership Act 1932) along with the fee will be submitted to the Registrar of
Firms. All the partners will be signing the application. The procedure of
partnership is given in the flowchart on the next page:

WHAT IS TRADE MARK?
Trade Mark enables consumers to identify a product of a particular company so
as to distinguish it from other identical or similar products provided by other
companies and also trade mark enables companies to differentiate their products
from their competitor’s products.
PROCEDURE OF TRADEMARK:
First of all a request form will be submitted to the registrar i.e. Form TM-55, along
with fee of Rs. 500/ and two sample of our proposed trade mark. On receiving
confirmation from the registrar, that there are no other trademarks that duplicate
ours, we will proceed with our application. An application for registration of
trademark is required to be made in duplicate in Form TM-1 to the registrar of
trademark along with the prescribed fee i.e. Rs.1000/-.
PROCEDURE AFTER SUBMITTING THE APPLICATION
An internal search will be carried out after the submission of application in order
to check there is no duplication of trademark. After the acceptance by the
registrar then the registrar shall cause the application accepted advertised in
trade mark journal and for all legal purposes a sufficient notice will be constituted.
If no objection is filed by the third party till the expiration of two months from the
advertisement date in the Journal, the Registrar will enter trade mark in the
register on payment of the registration fee of Rs. 3000/- and issue a certificate of
registration to the applicant.

(a) Insert the serial number of the class as indicated in Schedule IV to the Trade
Marks Rules 2004.
(b) Specify the goods or services. Only goods and services included in one and
the same class should be specified.
Please consult Schedule IV attached to the rules to check the class of goods and
services or the Book on International Classification of goods issued by the
International Bureau for the Protection of Intellectual Property, Geneva.
(c) Insert legible the full name, description and nationality of the applicant.
(d) Insert the trading style, if any.
(e) Insert the full trade or business address of the applicant.
(f) Strike out whichever is not applicable. If the mark is already in use, file the
proof thereof by way of affidavits, publicity material, sale figures etc.
