charge – Submitted – Regarding.

of A.R.Anantapur HAC of Supdt.of Police,Anantapur.

I, P.C.1354 G.Muralidhra of Dharmavaram Town PS submit that in the

reference cited a memorandum of charge under rule 20 of A.P.C.S ( CC&A ) Rules,1991
was framed against me and called for my written statement of defence for the following
alleged allegation.

“Exhibited gross negligence and irresponsible behaviour towards the

escaped remand prisoner No.1785 and a case registered at Guntakal II Town P.S. vide
Cr.No. 109/2010 dated 16-11-2010 on complaint of Escort Party.”

In this regard I submit that while I was on escort duty at District Armed
Reserve, Anantapur, the duty R.S.I. issued a passport for myself and P.Cs.1017&1915
directing us to report before the Sub-Jail Superintendent Gooty Sub-Jail to escort four(4)
prisoners to produce in the court of J.F.C.M. Guntakal. According to rules 4 prisoners have
to be escorted by 1 H.C. and 6 P.Cs. When myself and other P.Cs. specifically requested
the Duty R.S.I. to provide the full strength of escort party but the Duty R.S.I. informed that
due to shortage of staff he could not allot full strength and asked us to manage with 3 P.Cs.
only to escort 4 prisoners.

As such we left Anantapur and reached Gooty Sub-Jail on 16-11-2010 in a

bus and appeared before the Sub-Jail Superintendent . He handed over 4 prisoners namely
(1) Shaik Ansar Mohammad (2) Kapu Veeresh Gowd concerned in Cr.No.84/2009 of
Kasuapuram P.S. and Cr.No. 29/201 of Guntakal I Town P.S. respectively and (3)
B.H.Prasaramudu S/O Govindaraju and (4) S.Khaleel S/O Sattar concerned in Cr.Nos.
109/2010 and 106/2010 of Guntakal I Town P.S. respectively with instructions to produce
them before the J.F.C.M. Guntakal at 11 A.M. on 16-11-2010.
 As per the instructions of the Superintendent of Sub-Jail, Gooty,we took all
the four prisoners into out custody and put them hand-guffs only as the leading chain was
not provided to us.We all 3 Constables took 4 remand prisoners and produced them before
the J.F.C.M. Guntakal on the same day. The J.F.C.M. extended the remand period of all 4
remand prisoners and directed us to take back the prisoners and produce them in the Sub-
Jail,Gooty.

As per the instructions of the J.F.C.M. Guntakal we took all the 4 prisoners
in an Auto and reached Bus-Stand, Guntakal to go to Gooty and produce them in the Sub-
Jail,Gooty. When we wanted to alight from Auto at Bus-stand, Guntakal,one prisoner Shaik
Ansar Mohammad,the young prisoner whose aged is only 20 years with lean built and
hands, removed the hand-cuff which was put to him ,even before stopping the Auto at Bus-
stand, suddenly thrown us and escaped into the mob at the Bus-stand and disappeared.
Then we kept the three prisoners with on P.C. and went into the mob at the Bus-stand,
Guntakal and searched for the escaped prisoner but insoite of sincere and vigorous efforts
proved futile.

I further submit that we made sincers and vigorous efforts, could not catch
the escaped prisoner Shaik Ansar Mohammad, then we all went to Guntakal II Town P.S.
and preferred a complaint about the escape of one remand prisoner Shaik Ansar
Mohammad concerned in Cr.No. 84/2009 of Kasapuram P.S. who is native of Bellary of
Karnataka State,as per the telephonic instructions of the Duty R.S.I. received by P.C.1017.
The same was registered as Cr.No.109/2010 u/s 224 I.P.C. at Guntakal II Town Police
Station on the same day.

I further submit that according to rules 1 H.C. and 6 P.Cs. have to be

provided for ascording four (4) prisoners. When we were deputed to Gooty Sub-Jail by the
Duty R.S.I. we specifically requested him to provide full strength to the escort party ,but
the duty due to shortage of man power and asked us to manage with 3 P.Cs. only. Had the
Duty R.S.I. would have provided the full strength to the escort party this unhappy incident
would not have occurred at all. Further the escpee is very young criminal with is an built
and hands, though we put the hand cuff to his hand, he loosened and before alighting at
Guntakal Bus-stand form auto,suddenly thrown us and got down from the Auto and
escaped in the Bus-stand where there were number of passengers are waiting for busses.
Inspite of our making sincere and vigorous efforts we could not trace him.Immediately the
same was informed to Duty R.S.I. As per the instructions of the Duty R.S.I. we all went to
Guntakal II Town P.S. and reported about the escape of Shaik Ansar Mohammad, remand
prisoner and a case in Cr.No. 109/2010 u/s 224 IPC was registered at Guntakal II Town
P.S.
 I finally submit that if the full strength of 1 H.C. and 6 P.Cs. are provided to
escort 4 prisoners form Gooty-Sub-Jail to the court of J.F.C.M. Guntakal on 16-11-2010
this contingency would not have occured at all. Further the escapee is lean built and hands
and very young having only 20 years of age, loosened the hand-cuff while traveling in an
Auto form the court of J.F.C.M. to Guntakal Bus-stand, loosened the hand-cuffs, while we
are reaching Guntakal Bust-stand , suddenly thrown us and jumped down from the Auto
and escaped and disappeared in the mob who were waiting for buses in Bus-stand.
I submit that there was not neglect on my part is escorting the prisoner form the custody at
Guntakal Bus-stand.

I there fore request my bsnign Supdt.of Police, Anantapur to consider my

written statement of defence sympathetically and release me form suspension without pre
judice to the departmental action pending against me to enable me to prove my innocence
during the regular enquiry, for which act of kindness I shall ever remain greatful.
