ith all thats good in this country, with growing numbers of people recognizing that all are entitled to equal rights and, yes, marriage, someone always arrives on the scene saying heartless, mean and simply stupid things. Dr. Marcus Bachman believes gays are barbarians who must be disciplined and his wife Michele, who is running for president, believes gays are enslaved by their choice. Simply said, there are some people who and anti-LGBT and, of that crowd, there are some people who ignore reality, science and human nature. To set the record straight, for some people, is impossible. So, to repeat: The American Psychiatric Association says that being gay is a normal variation of human sexuality. So does the American Psychological Council, as well as the National Association of Social Workers. They all agree that reparative therapy is wrong and can lead to dire consequences for the person receiving such

treatment, including depression and even suicide. Despite the abysmal negativity of some people, lets look at the positive: New Yorks marriage law, the repeal of Dont Ask, Dont Tell, federal courts holding DOMA unconstitutional, the California marriage decision, and the bankruptcy court in California refusing to recognize DOMA and, ironically, giving equal rights to bankrupt married gay couples. (Although it wasnt really ironic in that case. Both partners were saddled with insurmountable medical bills and filed joint bankruptcy, which the court allowed. Yes! There are plenty of people out there who believe in LGBT rights. And, yes! There are also plenty of people who are rational and are willing to learn about LGBT equality, a subject about which they are not fully aware. Our opportunity as PFLAG members is to put on our advocacy and education hats and do what we really can do: rationally converse with our friends to persuade and convince these good people that equality is for everyone. Now thats something.

Co-parenting has no legal status in Ohio

By Maria L. Shinn, Esq., of Maria L. Shinn, LLC

Things just got tougher for nontraditional families in Ohio. Same-sex parents are already prohibited from seeking second-parent adoptions* in Ohio. Now, as a result of a recent Ohio Supreme Court ruling, non-biological and non-adoptive parents must have a shared custody agreement or a custody order from juvenile court in order to safeguard their rights with regard to their children. On July 12, the Ohio Supreme Court upheld lower court rulings that co-parent Michelle Hobbs is not entitled to shared custody of her former partners daughter. In a 4-3 decision, the Supreme Court ruled that although there was evidence showing that the girls biological mother, Kelly Mullen, had intended to share custody with Hobbs, there was also evidence that Mullen did not enter into an agreement with Hobbs to permanently relinquish sole legal custody of her child in favor of shared legal custody with Hobbs. The Supreme It affirmed the Court stated that lower courts decico-parent doe sion to dismiss Hobbs complaint not equate to for shared cusshared legal tody.

on Lucys ceremonial birth certificate. Hobbs and Mullen jointly cared for Lucy, supported her financially, and held themselves out and acted like a family. Lucy called Hobbs Momma. Mullen named Hobbs as Lucys guardian in her will and signed power of attorney documents, giving Hobbs the ability to make school, health, and other decisions for Lucy. The majority of the Supreme Court, however, agreed with the lower courts that the evidence was sufficient to dismiss Hobbs shared custody complaint. Mulled had refused to sign a shared custody agreement during her relationship with Hobbs. After their breakup, Mullen revoked the will and power of attorney documents which gave Hobbs some custodial responsibilities. The Supreme Court stated that co-parent does not equate to shared legal custody. Justice Pfeifer lamented in his dissent that the law has not caught up to our culture, and this court has failed to craft a rule that addresses reality...A maternal relationship existed between Hobbs and Lucy. Mullen taught her daughter to call another woman Momma and to love her as a mother. She now wishes she hadnt, and for the majority, thats enough. It shouldnt be.
*Second-parent adoptions allow same-sex couples to legally adopt a child together. Such adoptions are not permitted in Ohio, but they are allowed in states such as Arkansas, California, Colorado, Connecticut, Illinois, Indiana, Iowa, Maine, Massachusetts, Nevada, New Hampshire, New Jersey, New York, Oregon, Vermont, Washington, and the District of Columbia.

Soulforce Equality Ride

For the past five years, the Soulforce Equality Ride has traveled across the country visiting institutions of higher learning that discriminate against LGBTQ people. There are hundreds of schools in this country that still openly discriminate. Soulforce advocates principles of nonviolence to effect change, including the need to dismantle oppression at its source. We are now planning our next ride, set to embark in the spring of 2012. This year we are excited to announce an initiative called the Hit the Road! campaign. It allows individuals and groups the opportunity to join us on the ride as Virtual Equality Partners. The Rider Pages on the Soulforce website provide photos and bios about our riders, and are a method for riders friends and supporters to offer monetary gifts for the journey. Now other individuals and groups will be able to have their own Virtual Rider pages with photos, bios and descriptions of why they support the Equality Ride program. Virtual Rider pages open for an initial donation of $100. Virtual riders who raise $1,000 by the launch of 2012 will have their name listed on the outside of our bus! They will also get exclusive updates and videos from the road and be the first to get news about the 2012 ride. Registration includes a special kit, plus templates, and live tech support to support their Virtual Rider page. Find more information at http://www.soulforce.org/ programs/equality-ride/

U.N. votes for protection of gay rights

The United Nations, in a cautiously worded declaration, endorsed the rights of LGBT people for the first time ever in an historic resolution this summer. The resolution was hailed by the U.S. and other backers and decried by African and Islamic countries, according to the Associated Press. "This represents a historic moment to highlight the human rights abuses and violations that lesbian, gay, bisexual, and transgender people face around the world based solely on who they are and whom they love," U.S. Secretary of State Hillary Rodham Clinton said in a statement. The resolution expressed grave concern about abuses suffered by peoU.S. Secretary ple because of of State Hilary their sexual orientation, and Rodham Clinton commissioned a global report on discrimination of gays, which will be reviewed at a later meeting, according to news reports. Rights Council and gained 23 votes in favor and 19 against, the AP reported. Supporters included the United States, the European Union, Brazil and other Latin American countries. Those against included Russia, Saudi Arabia, Nigeria and Pakistan. China, Burkina Faso and Zambia abstained, the AP reported, Speaking on behalf of the Organization of the Islamic Conference, Pakistans ambassador to the U.N. in Geneva said the resolution had nothing to do with fundamental human rights, and Nigerias representative claimed the proposal went against the wishes of most Africans, according to AP report. According to Amnesty International, consensual same-sex relations are illegal in 76 countries worldwide, while harassment and discrimination are common in many more. "The Human Rights Council has taken a first bold step into territory previously considered off-limits," said Graeme Reid, director of the LGBT Rights program at Human Rights Watch in the AP report. "We hope this groundbreaking step will spur greater efforts to address the horrible abuses perpetrated on the basis of sexual orientation and gender identity."

Healthcare Equality Index

The Human Rights Campaign recently released its 2011 Healthcare Equality Index. The report rates 87 survey respondents (representing 375 facilities nationwide) on their policies related to LGBT patients and families. This years index lists a record-number of facilities working toward LGBT healthcare equality. Criteria for the index include: (1) a patients bill of rights and/or nondiscrimination policy that includes sexual orientation and gender identity/ expression, (2) visitation policies with explicitly LGBTinclusive language granting same-sex partners the same access as heterosexual couples and next of kin, (3) LGBT cultural competency training for staff, and (4) equal employment policies that include sexual orientation and gender identity. The highest rated facility in Northeast Ohio was the University of Toledo Medical Center which met every criteria except staff training. The Metro-Health System was rated as adequate on three of the four criteria, with select medical groups within Metro-Health scoring slightly higher. University Hospitals of Cleveland and the Cleveland Clinic Foundation rated well on patient rights and equal employment opportunities related to sexual orientation, but not gender identity/expression. These systems also do not include inclusive visitation policies. Download the report at: http://www.hrc.org/hei2011/ #.TjMgxYIrXSs
